Davis attended the party wearing an open back shirt. At one point, she stood nearby a large firepit where the fraternity had provided sticks and marshmallows for guests to roast. The firepit was unsupervised, according to the lawsuit.

As Davis stood with her back facing the firepit, another guest who was "visibly intoxicated" roasted a giant marshmallow, the lawsuit claims. When the marshmallow caught fire, the intoxicated partygoer allegedly shook her stick to extinguish the flames, but the marshmallow flew from the stick, landing on Davis' back and adhering to her skin.

Davis suffered a significant burn to her back and permanent scarring, according to the lawsuit. Photos of the injury enclosed in the suit show a large burn on Davis' lower back.

Honestly that sounds like a fairly legit suit.

The big money would be to go after the marshmallow company. Why do they have to make the flammable?

Your headline is misleading. The giant flaming marshmallow was not, exactly, the subject of the lawsuit.

It was the burn that it caused. Although I have not clicked the link... so not sure how severe. Nevertheless, your headline seems to be incorrect.

I’m surprised the marshmallow manufacturer wasn’t named for negligence by creating a flammable adhesive product.

I was going to come here to rant about people not taking responsibility, plaintiff's lawyers and bullshite lawsuits until I read this in the article:

quote:

In advance of the event, the fraternity sold $60 bracelets providing access to the party, which included unlimited drinks, free BBQ, fire pits, live DJs, fire performers and pirates, among other highlights, according to the lawsuit. Legal documents show Castle took in $60,000 for the event

All bets are off when you start charging people admission. You hold a for-profit event? You assume some liability. Buy insurance.

People don't burn people.

Flaming marshmallows burn people.

Access of a well regulated militia to flaming marshmallows shall not be infringed...

Why do people have to sue for shite like this.

I'm sure the person didn't mean to do it. It was a shitty accident, let the wound heal and treat with maderma. That shite works well.

If you need help with medical bills for it, despite it just being a burn that can be treated over the counter, then ask for help from the person who caused the damage.

I hate our overly litigious society.

I don’t see how that would make a party any better. But it’s not my money.
