A pledge has the reasonable expectation that he will not be encouraged to drink until he dies . So he takes a shot or two. Then a third and fourth. And this point moral responsibility SHIFTS to those who are still sober and/or in leadership. Now that he is impaired they have a legal and moral responsibility to proceed with caution. Particularly since he is a pledge, and is essentially “ auditioning “ for his spot in the fraternity, and wants to gain their favor. It is highly likely that members knew they went overboard and that at some point a “man of conscience “ should have stepped forward . They let a young kid, away from home for the first month, drink himself to death under their direction. That’s a legal and moral failure that should haunt them every day for the rest of their life.
As a former Frat star in the glory days of irresponsible drinking - I can tell you that I and others understand that we had a responsibility for the pledges welfare. You show them the ropes. You don’t feed them shots until they die. And if they do drink too much, you stay with them and get them medical help . Brother’s keeper and all that .

I get the moral argument. I don't get the legal one.
He's an adult that drank under his own free will. Its tragic, but its not a crime IMO.
Now, if there is evidence he was held down and forced to do it, game over.

Hazing in any form, or the use of any method of initiation into fraternal organizations in any educational institution supported wholly or in part by public funds, which is likely to cause bodily danger or physical punishment to any student or other person attending any such institution is prohibited.
Whoever violates the provisions of this Section shall be fined not less than ten dollars nor more than one hundred dollars, or imprisoned for not less than ten days nor more than thirty days, or both, and in addition, shall be expelled from the educational institution and not permitted to return during the current session or term in which the violation occurs.
If only the law you quoted titled "Hazing prohibited; penalties" explained EXACTLY what the penalty is in the last fricking sentence.

So these guys could get minimal criminal penalties, then discharge any civil liability through bankruptcy, and come out of this with nothing but a hit to their credit report for seven years. And maybe some difficulty finding jobs if a potential employer googles their name.
