I think it's up to the discretion of the officer if you get pulled over.
Just buy one of the mounts that attaches to the windshield or dashboard or A/C unit like someone else mentioned... they're only like 10-20 bucks on Amazon.

If your not holding the phone and constantly playing with it, then you will be fine.
As others have said, buy a phone mount, set it before you start driving and you will be fine

Only drawback I have found with Waze is that it won't route over 1000 miles so if it's a really long trip you will have to figure out some waypoints before leaving.

All I can say is that the toughest cell phone law I know of is in Georgia, where you essentially can't put your hands on your phone while driving. However, it is acceptable to use a windshield mount like device. So, what I gather, is that I would fight that second charge of using Waze. Unless WV laws are stiffer than the Georgia one.
My guess is the cop is just pissed at the use of waze, because it typically thwarts his ability to ticker folks because of the app's police notification feature.

I'm actually pissed Waze didn't warn me of him hiding out! Or of the speed limit change. I know the screen shows the changes but I wasn't even looking at the phone screen.
I'm 100% challenging the Waze ticket. But I'm paying the speeding ticket as I was in a work car. Not really trying to make it worse there or have any desire to deal with HR or whatever would come up for that part. Though it's probably inevitable given my challenge of the 2nd ticket.
