Nah, distracted driving is dangerous and causes majority of wrecks.

We tried to warn you.

Check out WV law. You may have a defense since you weren't holding it in your hand. LINK
quote:
(a) Except as provided in subsection (c) of this section, a person may not drive or operate a motor vehicle on a public street or highway while: (1) Texting; or
(2) Using a cell phone or other electronic communications device, unless the use is accomplished by hands-free equipment.
(b) For purposes of this section, the following terms shall mean:
***
(8) "Using a cell phone or other electronic communication device" means holding in a person's hand or hands an electronic communication device while:
(A) Viewing or transmitting images or data;
(B) Playing games;
(C) Composing, sending, reading, viewing, accessing, browsing, transmitting, saving or retrieving e-mail, text messages or other electronic data; or
(D) Engaging in a call.
Also, he only saw Waze chirp after you were stopped.
quote:
(2) "Driving" or "operating a motor vehicle" means operating a motor vehicle, with the motor running, including while temporarily stationary because of traffic, a traffic control device, or other momentary delays, but does not include operating a motor vehicle after the driver has moved the vehicle to the side of, or off, a highway and halted in a location where the vehicle can safely remain stationary.
See what statute he cited on the ticket. If it's this, then print the whole statute and get our your highlighter. But he may have cited a stricter local ordinance that you will have to find and review.
You're probably making this up, so it doesn't matter. I mean, what cop would say "in HIS county, driving while on a cellular phone was illegal. No exceptions." Wouldn't he say "in MY county"?

When I got hit with the lights, I took the exit, which was right there . . . let me know that "in HIS county, driving while on a cellular phone was illegal. No exceptions."
Just so we’re all clear here, you got stopped by a County Sheriff while on the Interstate? Not a State Trooper??
What shite luck you must have to be given a ticket for something you asked about on this forum last week. You’re the only person I have ever heard of getting a ticket for using a mounted GPS device.
This never happened and you are pathetic.

I just use the iPhone map, plug it into my truck and boom. Right on the screen.

I'd would ask if using a dedicated GPS IS allowed "in HIS county". I'd find out if hands-free operation of a cel phone is legal or not.

I'm actually pissed Waze didn't warn me of him hiding out!
Well it's dependent upon someone ratting out the cop.

Thx for that. I got a lawyer buddy checking those out too.
Sorry if I didn't quote him properly. Yes, he said "in my county".
Wasn't on interstate, was on a highway that cuts in & out of towns with 1 or 2 street lights. I just missed the damn speed change in this instance.
I'm not posting the ticket to chance 1 of you knuckleheads screwing me over or blasting my/sherrif/car/personal info I fail to blur out.

I'm not new here. I've seen how deep the OT will dive.
