In WI I have seen boilerplate that says something along the lines of "by Officer Dickwad, who is known to be truthful" in court papers.

If a cop says it, it carries weight in court.

You know better than anyone that just because the police thought he was the victim doesn’t make that a fact.

The fact that they marked him the victim in their report is one fact.

Other facts are that witnesses called police saying he was hitting her, trying to take her van and her phone.

All of these facts are evidence to be weighed in determining who is the victim, a fact that hasn’t been conclusively proven.

I like how your definition of facts vs evidence changes based on what you want to be a fact or not.

The hour+ video evidence from the cops bodycam and the cops assessment of the situation (as SFP said, we or the cops would see marks on the skin) casts doubt on a moment's glance from an eyewitness.

I'd agree it doesn't make it a fact 100%. It would take an actual professional psychologist to cast doubt on it, but it could be done sure.

Concerning the "her van" stuff; They were engaged and travelling the country for months together in said van. I'm sure they considered it "their van", even if the reg was in her name.

"Her van", that she stated was afraid of driving, is a distraction and unimportant.

They determine the alleged perpetrator and victim in the scenarios. It's their designations. Sometimes there are neither, but in this case they clearly designated the pair as such.
