unless it was self defense

This is why you don't get in fights. One punch too many and you're life is ruined. They hit their head weird on the ground and you're life is ruined.
Just not worth it.
ETA:
I'm sure he'll plea down and get 20 years or something. Still a life ruiner.
You have to intend to kill for murder..negligence or manslaughter at the highest.

This could've been like any other of the 99.99% of fights except one punch hit the exact wrong way on the skull by chance and the guy died.
Good guys get in drunk fights all the time. Any of them could have bad luck and kill a person
Happens but still very rare. Someone still ends up in prison in that scenario.
Can you not admit the fact that this is even brought up kind of brings up the idea this person has major major issues?

quote:Fair enough. I should amend to say "guys who drunkenly kill people AND are charged with 2nd degree murder aren't typically good guys."
That's ridiculous.
I don't know the guy, but good guys have gotten in drunken fights since the discovery of alcohol. We don't even know he started it.
Lets wait for some facts.
It's also hard not to think of the Joe McKnight case here. Despite the fact that the killer had a history of road rage, much of the finger pointing on here began and ended with McKnight himself. I wonder why.

Cameron Poe served 8 years in Con Air. So I don't see any way this guy serves less than an American hero.

The kicking when down is not a good look.
A few things that I want to know:
- Who initiated the altercation
- What was the BAC of each party
- Is there video?
- Did the victim have a pre-existing condition that led to death, when a normal healthy person would've survived injuries (wouldn't matter much in court, I'm just curious)

What does that have to do with anything?
There's a question of whether the charge should be manslaughter or murder.
I was curious and looked up the differences between the two charges to better understand why Ward was charged with 2nd degree murder. I'm guessing they felt there was malice aforethought when Ward delivered the killing blow.

No way. If this dude has access to money and hires decent representation, he’ll probably get sentenced to 5, likely serve 1.5. Quite possibly, even serve some of that on house arrest or in a halfway house. I’d be willing to bet on that.

No you don't. You have to intend to cause great bodily harm.

So what if this is the rare case?

Obviously he's going to prison. If you don't believe there are good people in prison that made mistakes that aren't reflective of their character, then I don't know what to tell you.

Officers responding to a 1:30 a.m. call of a beating on Jan. 6 found Ward on the upper level of an elevated parking lot in the 2000 block of St. Charles Avenue after witnesses accused him of punching and kicking Jackson several times.
According to police, Ward was "highly intoxicated," and he was booked on suspicion of battery while paramedics took Jackson to a local hospital for treatment.
What is this elevated parking lot in that block? Cheese Cake Bistro?

Road rage to the point of murder doesn't qualify that person as "good" to me. He has serious issues with anger at the very least.

Do you know for sure he continued to kick him while he was down?

Murder is premeditated.
huh?
quote:
Second degree murder A. Second degree murder is the killing of a human being: (1) When the offender has a specific intent to kill or to inflict great bodily harm; or (2) When the offender is engaged in the perpetration or attempted perpetration of aggravated or first degree rape, forcible or second degree rape, aggravated arson, aggravated burglary, aggravated kidnapping, second degree kidnapping, aggravated escape, assault by drive-by shooting, armed robbery, first degree robbery, second degree robbery, simple robbery, cruelty to juveniles, second degree cruelty to juveniles, or terrorism, even though he has no intent to kill or to inflict great bodily harm. (3) When the offender unlawfully distributes or dispenses a controlled dangerous substance listed in Schedules I through V of the Uniform Controlled Dangerous Substances Law, or any combination thereof, which is the direct cause of the death of the recipient who ingested or consumed the controlled dangerous substance. (4) When the offender unlawfully distributes or dispenses a controlled dangerous substance listed in Schedules I through V of the Uniform Controlled Dangerous Substances Law, or any combination thereof, to another who subsequently distributes or dispenses such controlled dangerous substance which is the direct cause of the death of the person who ingested or consumed the controlled dangerous substance.
Intent isn't the only issue.

Man you're really trying so hard to be in denial
quote:
Ward was arrested at the time of the beating after two witnesses said they saw him punch the man now identified as Jackson in the face and body "several times" and then twice kick him in the head after Jackson had fallen down, his warrant from the battery arrest states
If the threat was over, this is murder. He died from his injuries per the coroner, not a pre-existing condition
