what difference would it make?
If the person was not crossing the road properly it could have been an unavoidable accident caused by the pedestrian. Or it could be like that accident Tesla had a few years ago where a white van on the side of the road wasn't properly spotted because of the color. A tweak will need to be made and this poor pedestrian's family will get paid.
The other interesting question to come out of this is who is criminally liable if the pedestrian wasn't at fault. Uber got special permission to test this, but surely that doesn't give you a license to kill. But which human is to blame? The CEO, the programmer, the project manager?

Plenty of real drivers hit pedestrians. Sometimes it’s the driver’s fault, sometimes the pedestrian’s, sometimes a combination of both. Self driving cars don’t need to achieve perfection, they just have to beat the average set by current drivers.

Thats fair. But if a human was driving at least blame can be placed.
So cars that hit pedestrians in thr future will be scrapped right? I mean how do you know the car wont mess up again?

Pedestrian can do things that make it impossible for a vehicle not to hit them. so yea, it matters, in part, if they were in a cross walk.

Yeah, and I had just barely enough reaction time to avoid hitting her. If she had stepped out a half-second later, no me or a computer could have stopped in time. And the computer is going to react faster than me, most likely.

how many people would you say use the crosswalks in a 1 hour period during the day in a busy city?
i dont know what city you live in but this happens constantly in nashville.
i'm not going to go into the demographics of who is more prone to jaywalk but suffice it to say this happens enough that i cant imagine an autonomous car being injected into the mix without catastrophic results.

Like I said above, if we took that mentality you just admitted to having, we wouldn't have basically anything we currently have now, all those luxuries wouldn't exist, and we'd still be doing horse and buggy.

Those are the concerns the industry will have to address.
Should/can it see people over the roof of a car but not actually in the roadway?
Also, at what lengths should the car go to prevent hitting a pedestrian or another vehicle? Should it swerve if it is safe to do so, or is braking the only option?
