Never been but I'm pretty sure you gotta sign a ton of waivers, but still lawyers will sue anyway, the guy that owns it is beyond wealthy, I'm sure they have an arse ton of insurance etc.
The people who died in these events were full-grown consenting adults who knew the risk of their recreational activities - if they chose to add alcohol into the equation then they are even more culpable for their demise. It's not like 30-year-old individuals are unaware that ATVs, alcohol, and night time riding wasn't extremely dangerous. I say all this to simply get to this point: lawyers may find a way to sue the property owner, but they shouldn't be able to...life is inherently dangerous and we are all guaranteed death - at least they went out enjoying themselves.

Why should a business get sued when someone dies in an ATV accident at 11pm and 2 am?

I can't speak for others but I bought mine because the wife and I like to rode around and play in the mud. We don't go on busy weekends like this because of the dumbasses.
We go on off weekends where there is barely anyone there so we don't have to worry about drunk underage kids riding like fools or drunk adults who act like kids.
It got alot more popular once "hick hop" became more popular music.

That's very true. But that would make that guy culpable, maybe (depends on the variables), not the property owner.

10pm is enough time for someone to go eat and hang out with their buddies for a bit, and then make it back to camp

If someone makes a conscious decision to do these things and die then that is ok with me. This is America. People should be free to kill themselves and their families shouldn't be able to sue over it.

If people are stupid enough to do this type of shite drunk at the middle of the night, then I don't see how the Owners should be held responsible for other people's stupidity. ATVs are very dangerous and if you are an adult and drive on one drunk at a mud park, then you should know what the consequences could be.

It is dangerous during the day too. You have 20ft tall trucks that can't see the four wheelers zipping around them and run them over. In the mud holes, the truck guys go as fast as they can through the same holes people on four wheelers go through

The property owners provided a place where this type of hazardous ( drinking and riding ATVs) activity was occurring, they knew about it, and did nothing to stop it. There have been a number of successful lawsuits where property owners willingly allowed potentially harmful activity to take place that would not have likely occurred in another setting. One was a couple that allowed their lake house to be used for drinking parties by their teenage kids and their friends, there was unfortunately a drowning and the parents where held responsible. They knew their property was being used for activities that any ordinary person would see as likely to result in harm and did nothing to prevent it. Don't shoot the messenger, just throwing out a possible legal ramification.

It is better run up here in the north. Poker run I'm goin on sat doesn't allow alcohol on the trail.
