Good argument. If you'd like we can turn the thread into a discussion of all the weak, cowardly reasons the police have used to execute people and pets. Hell, I think the neighbor's attorney should argue this angle at trial. If the police can show up and sling lead without good reason, then surely a citizen that's just been assaulted can do the same.

Like I said, I’m willing to entertain bets. I don’t think this guy is getting out of jail time.
It’s going to be pretty hard for this old guy to get off if he doesn’t testify. I’m thinking he has to testify given the video evidence. You’re starting from the default of this guy killing someone because he was sprayed with water. He’s going to have to explain why he has his gun on him. It will be interesting to see how he explains that one. He’s also going to have to explain why he shot him.
Saying he’s gone through years of abuse doesn’t work. If he didn’t fear for his life but was angered by the pest of a neighbor. Even then, which I don’t believe is reasonable for the heat of passion of an average person, it’s manslaughter.
I’ll give you my prediction. They are going to hang life in prison over the old guy. He’ll agree to manslaughter. The judge will give him 10 years jail time given his age.

You haven't seen the video, so you don't actually know that to be the full story; but we all now know this Lee dude had a long arrest record and was in the middle of assaulting this neighbor when this happened. You can think what you want, but a good defense attorney is going to weave all of this into quite a strong defense.

You’re having a tough time comprehending that I was in the wrong. I didn’t like seeing a gun under those circumstances, and I believe he could have made the point without a gun. But legally he did nothing wrong, and I don’t believe the law should be changed to make what he did wrong.
What if I was casing his house? He didn’t know.
