What we need: appointed state court judges, repeal of direct action statute, admissibility of seatbelt defense, meaningful supreme court restriction of lawyer advertising

What we do not need: more jury trials held before what is a largely unsophisticated and under educated state population, continued precedent that lawyer advertising is unassailable as free speech

I dont know a defense lawyer worth their salt that wouldn't request a jury trial on anything over the jury threshold and those below the threshold usually settle. Source: I'm a defense lawyer

But at the end of the day, a rising tide raises all ships. As much as clients would like a change, it could impact the defense bar, as well. Less suit, less hours, less money.

You know why this does not happen? The injured claimants would get their bills paid and then retain an attorney too pursue other elements of their claim. It owuld be very rare that a person would not retain counsel if that is wha they were going to do al along. They are influenced by the volume of advertising as well as their friends and realtives who tell them horror stories about insurance companies which are not true or greatly exaggerated.

Simple solution to this. Go to a no fault system and make all auto insurance first party.

You get into an accident, you go against your own policy for medical, lost wages, etc.

Only way you can sue the other driver is if they cause grave bodily harm or death, or are intoxicated.

People that say they have a "simple somution" to complex issues are usually talking out of their arse, and this post proves it.

No shite, but your statement could not be more wrong. There are way more bench trials than jury trials. WAY more. Like probably 20 to 1 or more.
