Tree falling and hitting neighbors fence

why did it fall over? did you have shite hanging from the tree onto the other persons property and has your neighbor spoken to you about it?

Not your problem unless the tree was rotting or in danger of falling and you knew about it and did nothing

Technically, provided it was not rotting and you exercised proper care, it is not your problem. Rather, the neighbor could make an insurance claim on his homeowners other structures coverage. If the damage exceeds his deductible the carrier would pay.
Now for reality. If you go this route and do not offer to chip in you risk making an enemy of your neighbor which can suck provided you want to live in relative harmony with the guy that lives next door.
If it were me, I'd walk over and offer to chip in 1/2 because I'm not trash and it's not worth making an enemy over.

He shouldn't need an entire fence replaced. Most likely one section.
I'd offer to make the repairs myself if my tree fell on a neighbors fence and tell them to kick rocks if they declined.

Rotten or not, you are responsible for removing the tree. It's your property that fell on his. Force majeure has nothing to do with that part of it.
Other posters are correct about you not being reposible for fixing the fence unless the neighbor informed you or can show that you should have known the tree was in poor condition (assuming it was in poor condition.).

That's a great attitude that you've got there. If I was your neighbor, and you wouldn't at least pay for 1/2 of the repair, you can bet your arse I'd be looking for ways to frick you.
