Not sure what's confusing there. It's unlikely that a person's significant other will ever be charged with a hate crime, and that's what the girl is. It's far more likely it was a domestic related thing than him being killed becsuse of sexual orientation.
And finally, they're absolutely right wondering why anyone would worry about a hate crime when they're charged with the most serious offense under the law.
