Wouldn't this just be a small claims type of thing? I can't imagine one of those gates doing more than scratching the paint, maybe a small dent. The damages can't be more than a few hundred dollars..

Its the HOA’s problem, not yours. Tenant should get in touch with HOA and file a claim against HOA’s insurer for the damages

If I were on that jury, I'd vote in favor of the tenant for whatever absurd number they ask for just because of the insufferable shite you do here.
The beauty is that if this weren't bullshite I'd know the details of the case enough to know it's you if I'd get lucky enough to sit on that jury. I'd do my best to bankrupt you over a ding in a car door.
Then, after I'd ruined you financially, I'd latch onto those shoes hanging out of your arse and drag S out of there so I could give both of you the Sonic experience.

Gates don't just malfunction and slam close on vehicles. They have built in pressure sensors to reverse when hitting something and other safety devices that prevent the gate from closing on vehicles. Also if he is talking about the photo eye malfunctioning I call bullshite especially if this is a 2016 or newer operator bc those operators will not operate without a functioning safety device like a photo eye. Without all the details it sounds like 1 of 2 things. Either he tried to tailgate thru it at the last second and scrapped up his car bc the gate couldn't reverse quick enough or and much much less likely especially if this is the first incident with the gate is installation error on the safety devices.
