I didn't read all of the responses here. My subdivision is gated and we have camera surveillance at every gate. 100% of the time that this happens, someone tries to speed through the gate behind another vehicle and the gate doesn't have time to reverse itself. We send the offender a bill for damage to the gate...

HOA dues include insurance for common areas. I would assume the damage cause by the gate would be covered under that.

If they damage the gate and don't report it, we contact the police and have them cited...and then send them a bill.

How does this even happen even if the gate is malfunctioning?

Was your tenant being an idiot and stopped his car in the middle of the gate path?

If I saw that gate closing I'd gun it.
