Dead people can't sue, no matter how they die.

They might be able to vote, but they can't sue.

I saw a lot of these in Paris but I think they were different in that they could be dropped off anywhere. In BR, can you only drop them off at bike racks ?

Not sure. Also, what if you go into a store and someone steals the thing?

Pretty sure you lose your deposit.

I saw a guy riding a bike, eating a biscuit and drinking a mountain dew the other day. I was impressed.

He was doing all those at once in case I wasnt clear.

Gotcha. I asked because I had no clue. I've heard of it some cases but maybe not in LA. I had a co-worker's cousin get one on a riding lawnmower

IIRC the issue with the LA court was the law uses the words "motor vehicle" then a list of things like aircraft and watercraft and ends with other means of conveyance. The LASC decided other means could mean either motorized or not motorized so with the ambiguity they ruled for the accused. The legislature has never addressed the ambiguity.

Lawnmowers or any other motorized transport would not fall into this loophole.

HOWEVER, I came back to this thread since my wife and I were talking about the Gotcha bikes and she told me they were e-bikes which I did not realize. The motor means these particular bikes would indeed fall under the LA DUI laws.

I am sure you don't care about the code sections or the SCLA case but if you do and can't find them with a simple Google I will track them down for you.

Oh. Those. They'll be deposited into the nearest canal or ditch soon, and our brilliant city leadership that was talked into somehow partnering with their company will soon be nowhere to be found.

If it’s Velib that you are talking about
You have to put those in the racks after using it or you’ll continue to get charged
Like NYC there aren’t just tons of the racks to dock them

There are over 1200 docking stations across the city of Paris
In NYC a little over 750
For NYC you use an app on your phone to sign up for one and use it

They average 350 rentals a day BR Business Report

yea 350 rentals daily according to a "company official" who has his/her hands in that $800k contract. here's the real take away from that article,

"The company, however, did not provide data on bike rentals per location. Neither did the city-parish, which awarded the five-year bike share contract last fall to Gotcha—a South Carolina company—for $800,000, the majority of which is funded via a federal grant."

aka bullshite.

there is absolutely no way in hell they're averaging 350 bike rentals per day in Baton Rouge of all places.

Louisiana Supreme Court says you cannot get one on a bike, unless that has been overturned with legislation in the five years since I lived there. It was basically ruled the law wasn't clear enough and bikes didn't count.

It would be interesting on the interpretation of Gotcha bikes since they have an electric motor in them.

I mentioned this last night but went back today and read the statute and LASC decision [State v. Carr, 761 So. 2d 1271 (La. 2000)] and the court's only rationale for overturning the appeals court thus interpreting the statute as NOT applying to bicycles was the lack of a motor. Given this opinion, I think it is pretty safe to say that the Gotcha bikes and any e-bike would be covered under the DUI statute. How strictly it would be enforced is another matter.

The ones in Nola you just put the u bolt in. It's useless then. They would have to have an account to unlock it and rude away with it. Sure someone can throw it in their pick up, but it has gps and the parts are proprietary. So again it's useless to steal.

These you don't need to return to the rack. You can just leave it in your front yard if you want. Either someone will walk by and rent it or it will eventually be picked up for service.

My alcoholic neighbor once got a DUI on a riding lawnmower. He was riding it up to the convenience store to get beer after he lost his license !

350 rentals a day in Baton Rouge is utter bullshite. I have yet to see one person on the bikes and I'm all over downtown.
