now you are changing course.

Saying frick you to a cop isn't going to hold up for disturbing the peace. Check the precedent listed on page 1 for some references.

no feelings in the way of logic. The cop was thin skinned and insecure and unnecessarily escalated the situation because his feelings were hurt.

I support the cop in this situation. No change of course. Again, here's the law in LA...
quote:

Louisiana RS 14:103 Disturbing the Peace

§103. Disturbing the peace

A. Disturbing the peace is the doing of any of the following in such manner as would foreseeably disturb or alarm the public:

(1) Engaging in a fistic encounter; or

(2) Addressing any offensive, derisive, or annoying words to any other person who is lawfully in any street, or other public place; or call him by any offensive or derisive name, or make any noise or exclamation in his presence and hearing with the intent to deride, offend, or annoy him, or to prevent him from pursuing his lawful business, occupation, or duty;
Whether it holds up depends upon the court.

I see what you're saying. I'm not lying. His subsequent actions justify arrest even if you think his initial action doesn't. Legally, the law supports his arrest based upon his initial action. I'm not really changing course though. My response may seem disjointed because I'm responding to a few posters in this thread.

Here...His 1st action, by law in La is an offense that merits arrest. If you're not convinced of that, then his putting his truck into gear as the officer is attempting to arrest him and the subsequent fight certainly is. That's my position. Now you'll say he's resisting an unlawful arrest. I see where there is no remedy for that in the law at the time of arrest. That's it. It will have to be hashed out in court. Had he not been a belligerent when called out about his shite parking, none of this would have happened.

I agree. Yet, the officer could have avoided the whole situation by letting the guy leave (moving his truck). The whole indent was unnecessarily escalated by an insecure cop who got his feelings hurt. It's the fricking car pool line and he wanted to arrest the guy who was in the process of moving his car out of the way.

But we have enough to support the cop against this piece of shite? You can't have it both ways. Obvious the comments are based on the fact that are alleged.

Collins then told the subject, identified in the report and booking information as Billy Wayne Rhodes (pictured), 44, of Batesville, that he was under arrest. Collins said Rhodes then got into his truck and slammed the door in the officer’s face. When Collins opened the door and reached in to get Rhodes, the deputy reported Rhodes jerked away and slammed the truck into gear with the truck’s front and back doors still open and the children inside with their seat belts unbuckled.

Lmao at how trashy this idiot is. Cannot believe the OT is siding with this mouth breather.

Why in the hell would anyone want to be a policeman.Billy Wayne was being an arsehole and look at how many people want to take his side.Just about every police department in the country is short of cops.Anybody that ever needs a cop should find a Billy Wayne to help them out.I’m afraid that’s where the country is headed.

It aint about sides, the entire reason the cop was there was to get the truck moved, when man is trying to move the truck he stopped it because his little feelings got hurt.

At this point he has completely stopped traffic, turned a few mean words into a physical confrontation, and wasted everyone's time and money for something that will likely be tossed out of court.

Are you not able to grasp this?

Hopefully this will allow them to change the law. People that park and block the carpool lane should be tased immediately upon exiting their vehicle.

Once they ride the lightning, it will serve as a small education that their rights end where others rights begin. If Billy Wayne was wired up, laying on the ground, doing the chicken, he would have been able to get back in his truck and leave, a free man.

Ultimately. Billy Wayne would know, from then on, not to violate the sanctity of the carpool line.

This didn’t happen in Louisiana. What is the relevant law in this case?

Also remember, the story gets its facts from the police report.
