Scratch my original comment. They apparently chose to use the new selection process. He was "randomly" selected. And apparently they don't feel the need to force someone connected to the case to recuse themselves.

The entire thing is so FUBAR that even the biker who did murder someone will wind up getting off for judicial misconduct. This should be a national story quite honestly how the justice system is 3rd world in some parts of the US. If you are guilty or innocent you still have a basic right of fairness in the process and this entire situation is the epitome of a completely broken and unfair system.
The Texas Bar Association and Texas Supreme Court must step in immediately before any more damage is done to the image of the justice system in Texas.

I admit I haven't kept up with this after the initial incident, but this makes it sound like the police escalated the situation. I was under the impression that the bikers started shooting. Is this not what happened?

It's not fake. There's two links in here, one to Channel 8 out of Waco the other to the Waco Tribune, that both verify the story is true.

That's still very much in dispute. And the problem is the Waco police have seized all the video of what happened and refuse to release any of it.
