re: The entire personal injury racket is corrupt, and it's not just the plaintiff lawyers.

Tell me Lammo. Why don’t plaintiff attorneys (non-maritime) like Federal court?
Competent judges (for the most part) who aren’t looking at the next election, professional staff, well managed dockets.... hmmmm. I wonder. We both know why.
If the state judicial system looked like the federal. I’d be 100% on board with that.

I’m not sure if the procedure. It is being done by a spine specialist not pain management. It will be a simpler process because she will be in and out failry quick. She doesn’t say much about but is sick because it has taken so long to get to this point. Finally after 5 rounds of cortisone the freaking doctors are willing to try something else. This is classic good ole boy network at its best.

We love fed court, better judges and better defense lawyers.

I don't mind federal court. I even file some suits there.

depends on the court/lawyer but i love federal court
i know some lower level PI guys who dread it, though. hell even e-file (which i love) is beyond them and their staff

Correct... I bumped into a guy and he had no damage outside of a scratch on his vehicle. The cop came, did not issue a ticket as we agreed that insurance could handle it. I found out he is suing my insurance company saying he had a bunch of injuries from the incident.
I hit him at a stop sign when I let off the brake to move forward because I thought he was going and instead he hit his brakes.

How do you know the bump did not hurt him?
Are you a doctor?
Did you examine him/ his x-rays/ his MRIs?
Some major accidents cause no injuries; some minor ones do. Any orthopedist will acknowledge that. You can blow out a disc stepping off a curb.
Why do you open the egg carton and examine all the eggs before you buy? Because sometimes an egg is cracked even if the carton is intact and undented.
You hit another vehicle. Drive better, and quit your bitching.
Take some personal responsibility, right?

You know for a competent lawyer, you sound like a whiny bitch.
1. You have to try and screw people out of what they paid their premiums for.
2. You work for insurance companies thats whole purpose is to rake in as much cash as possible and not render any services.
3. Your a dime a dozen lawyer that has more competition than plumbers and hvac technicians.
4. You are a sub to someone that bullys you around and tells you what you can charge.
5. Funny all that education to chase around little old ladies that get in car wrecks.
Thanks for the post though.

1983 claims are 100% better off in front of a federal judge than your average LA state court judge

since we're using juries to create this market, you believe in reducing the jury threshold to $0, right?
if not, don't make a "conservative" argument

No, SFP, I don't think the dockets should be clogged by 2-3 day jury trials for $5000 cases.
And don't try to tell me what arguments to use. It's not your place.

why not?
i do PI and have no problem with it. i'm not worried about my abilities in front of a jury
the cases clogging dockets are manufactured, billboard mill $5k claims that make the system more expensive for real PI claims
those claims only get pursued because of our $25k jury threshold. it keeps the morris barts in business
if more legit claims got to go in front of juries, they'd be worth more. it's not like defense companies want to go to trial

The small cases usually get settled pre-suit.
Have you ever tried a small case 2 days before a Texas jury? I have. It's not worth your time. But that is what the tort deformers are counting on.
Don't play into their hands.

Oh, BTW, our jury threshold if $50,000.

yeah sorry that's city court jurisdiction (which is a different issue). same thing though
gutting small cases gets the focus on real cases and hurts the mills. i will never understand why small fish like you and me not only defend the system that makes gordan mckernan and morris bart rich, but also allows them to ruin our reputation

When you're driving at least 30 miles down I-12 from downtown Baton Rouge to the out limits of denham springs and there's billboard after billboard covered in ads for the typical ambulance chasing trial lawyers and there's public transit bus in town doing the same as well with the ads, you know something is fricking wrong and come to the realization that Louisiana has one of the worst legal climates in the country.
