I think the dissenting judge’s opinion highlights the issue quite nicely, to be honest:

The system is corrupt and broken, but NADA (along with their state-level counterparts) have managed to get the corruption codified in state laws. And then they got their members placed as regulators responsible for enforcing those laws.
It’s a tale as old as time but I’m glad Tesla is at least shining a light on it.

LOL No. Dealers hold the inventory and they pay interest to the manufacturer to hold said inventory. Manuf. can push dogs onto dealers. "oh you want to sell some raptors, you gotta take these shite brown fusions first." Most dealers have 10's of millions in their stores they would not take being pushed out laying down after the manuf. told them how big their store needs to be to push the brand. We think of ourselves as astute buyers but many many cars are impulse purchases. Most people don't want to wait. Many cars are sold through service. "can't afford to put a $6k trans in your car well let's walk over and get you in something new. Oh don't worry about that negative equity we can roll that rifght into the new payment" Also dealers can push interest rates on to poor credit buyers that manuf. could never get away with. That sells cars. The big manufacturers do not want to be in the retail game. Ford is already backing away from that.
Before you accuse me of being a salesman, I have never been in the car business but I have made friends with some big players who own many dealerships. One is building a new Porsche store in a major market. I asked him will the store be the same as the flagship store they already have. he says "no, it's bigger it's always bigger" Porsche makes them build a certain size to represent the brand properly in a given market. They are not going to start selling cars agains them.

Not anytime soon. The demand would outpace supply for a while, so it would be expensive as hell to summon one for a daily commute.

So the whole process is just as scummy and predatory as it feels.

No it’s not
Liberals don’t want us to drive trucks and eat meat and they get laws passed. Because this is a conservative state we should be able to ban liberal things. Seems like some of you liberals forgot what happened last time they banned states rights

I don’t have any issue with manufacturers taking this approach. I’m plenty of manufacturers in plenty of industries elect to sell through a distribution network rather than selling directly to end-users. It’s nothing new.
I do have a big problem with the government mandating that specific business model. Manufacturers should be able to choose their go-to-market strategy.

The Louisiana dealer lobby is really big and politicians are corrupt AF. The fact that this even had to go to court is insane

What this did to Telsa was that it also prohibited the New Orleans Tesla location from offering demo drives, in addition to picking up your new vehicle from that location. Anyone wanting to buy a Tesla in LA, or even do a test drive, has to go to Pensacola or Brandon MS.
