Tesla Inc. is under investigation by the Justice Department over public statements made by the company and Chief Executive Officer Elon Musk, according to two people familiar with the matter. The criminal probe is running alongside a previously reported civil inquiry by securities regulators.

Federal prosecutors opened a fraud investigation after Musk tweeted last month that he was contemplating taking Tesla private and had “funding secured” for the deal, said the people, who were granted anonymity to discuss a confidential criminal probe. The tweet initially sent the company’s shares higher. Tesla confirmed it has been contacted by the Justice Department.

Musk made a moronic tweet and has absolutely no evidence to back it up with. That funding doesn’t even exist, the Saudi investment group that was rumored completely distanced themselves from this fiasco and even the board of Tesla said they had no idea what he was talking about. Oh and then Elon did an interview and blamed the tweet on ambien to weasel out of it. Lastly musk is fairly conservative and has been invited and attended meetings with Trump so obviously trump hates the guy... definitely a trump issue

Has nothing to do with federal loans. You can't just haphazardly say you are taking the company private and have funding when you are a public company.

What he did is pretty much the definition of fraud. He made a false statement to artificially increase the share price of his company.

Does that excuse him from stock manipulation? Especially since he made blatantly false statements in an effort to hurt people betting against his stock.

Cost people millions.

Huh? Making a public statement while public really only serves the public shareholder. If it devalues the stock due to holder sell, the company suffers. Those who hold, well, hold.

If the stock goes up? Guess what... shareholders aren't being defrauded.

So the shareholders of Enron weren't being defrauded for the years leading up to the folding of the business? Interesting theory.

His problem is actually more complicated than that. Does Twitter even constitute a public enough forum for such statements even if they were true?

As it stands he could be accused of stock manipulation and insider trading. Although I have to imagine nothing will ultimately happen.

Musk said contemplating. He didn't say he was going to do it. Where's the fraud?
Put him out of business to protect yet more industries that are turning obsolete?
