Sure she may be able to sue the student. but the school? Fact remains she brought nude pics and maybe porn to school. Anyone who says she didn't is just being naive.

How. The base fact of the matter is she had nude pictures (doesn't make a shite difference if it was of her or not) at school. The medium in which she brought them to school does not matter. Again, I'm not for firing her. I do think her rights were violated by the student. Doesn't mean at the base of the matter, what she had with her was inappropriate to have at school.
I make the reference to the magazine, because that stands out to us as wrong. But to put it in a little black square electronic device, which is just as easily accessible as turning a page of a magazine, is somehow different. "But it was her personal phone, blah blah blah". It could have been her personal magazine or photo album in her purse. It's the same thing.

Well, for starters, one has the sole purpose of distributing pornography, the other does not. If they went through her internet browser and found a porn website on her browsing history, would that be the same as well?

That's slightly different, but there is still the argument that she allowed access to internet sites that would usually be blocked by the schools browser. If the school had laptops that blocked those websites, but she brought a laptop from home and left it to where kids could access, I'd say she may still get in trouble. Now, I would have a different opinion about all of this if the phone was protected with a password (same for the computer)

If schools want to demand all staff have passcodes on their phones then sure, but your logic about possession of porn at school is far-fetched and just typical for your arguments aka DUMB.

MY post about La's new law is indicative of the culture change to a "connected" society. I'm proud our state has done something like that b/c it's no longer a stigma to have or share intimate media between consenting adults(17+).
And dick-moves like this or ex-lovers posting on facebook(I have a gal friend who's ex did this 3 years ago BADDDD. very graphic shite all over FB for a few hours) can now be prosecuted under the same premise of a 'connected society'.

That's about only way any of this gets addressed. All devices must use facility wifi for connectivity.
Side note.
I was at OLOM Saturday for Quizbowl. Their guest wifi didn't allow facebook. I didn't realize I was on it and was like WTF.

Because it was obviously was accessible. Password makes it not accessible. Having that accessible to students (even if the student had to break a rule to get to it) is a problem. You know, because children tend to break rules sometimes.
I totally think this sucks for her. I would not want to be the principal and I'd try to find a way to not do this if I was. But I think if I was a lawyer, I could fight on behalf of the school district easily if needed.

Did shet have nudes in her phone on school property? Yes or no? I'll answer for you. Yes, she did. It's not an oversimplification; it's what she did.
Oh and the kid did not Google nudies in her phone browser. Stick to the facts. Such as her bringing nude digital pics on school property.
