Why are so many wanting this to be an illegal alien? American citizens commit crimes too. Do you think that everyone with a Hispanic name is an illegal immigrant? That only illegal immigrants commit crime?

I don't recall the legalities of an in-custody interrogation and the requirement for the presence of counsel, in that jurisdiction it might even vary although it is primarily a universal constitutional requirement, but questioning him about something with which he isn't charged yet may or may not trigger the automatic right to counsel. It has been a while since I reviewed that issue. Someone more current might want to chime in on that.
Actual arrest doesn't matter. As soon as a subject is detained (i.e. a reasonable person would think he is not free to go) Miranda is applicable. Any custodial interrogation requires the subject to receive his Miranda rights given.

The article says the authorities can neither confirm nor deny his citizenship to this point. So, unless you have information that hasn't yet been provided, I'll defer to the article and the authorities saying it's not confirmed.
So instead of being so quick to be smug, maybe read the article and understand the context.
