From Puerto Rico.

American citizen.

That's how Puerto Rico works.

Why are so many wanting this to be an illegal alien? American citizens commit crimes too. Do you think that everyone with a Hispanic name is an illegal immigrant? That only illegal immigrants commit crime?

Well, if he is from Puerto Rico, I'd say that wouldn't matter.

Probably to bolster the case against allowing 3rd world aliens from areas with a differing value system and culture from pouring into our country unregulated and contributing to social conflicts and strains on our political system.

You know no one thinks any of that. That's a non sequitur.

I don't recall the legalities of an in-custody interrogation and the requirement for the presence of counsel, in that jurisdiction it might even vary although it is primarily a universal constitutional requirement, but questioning him about something with which he isn't charged yet may or may not trigger the automatic right to counsel. It has been a while since I reviewed that issue. Someone more current might want to chime in on that.

Actual arrest doesn't matter. As soon as a subject is detained (i.e. a reasonable person would think he is not free to go) Miranda is applicable. Any custodial interrogation requires the subject to receive his Miranda rights given.

Public records indicate Colon-Ortiz is from Puerto Rico, which would make him an American citizen.

This shite right here needs to change. We need to cut that place loose instead of carrying them.

Maybe, maybe not. But irrelevant to my post answering his question though.

Personally I think the case is pretty strong as is.

Not Miranda. Anyone that has watched Law and Order knows that.

I am talking about Fifth and Sixth automatic attachments based on custodial situation and intent to prosecute. There are certain situations in which the accused can't waive counsel without some specific actions.

The article says the authorities can neither confirm nor deny his citizenship to this point. So, unless you have information that hasn't yet been provided, I'll defer to the article and the authorities saying it's not confirmed.

So instead of being so quick to be smug, maybe read the article and understand the context.

You mean the same article that indicates that records show he is from Puerto Rico, a US territory of whom the inhabitants are American citizens?

In what sense? Maybe you should go back and pick up a few periodicals from 1898 so you can better understand our relationship with PR.

Sorta Rican, actually.

Not that I'm standing up for this POS killer but it just amazes me people have to ask about the immigration status of a Puerto Rican.
