Not sure if it is illegal for the DA to do what he did or say what he said.

quote:

WASHINGTON — Prosecutor Stephen Lanier's meaning was unmistakable when he urged jurors in north Georgia to sentence the defendant to death in part to deter other people "out there in the projects."

Almost everyone in the public housing apartments near the scene of the killing of a 79-year-old woman in Rome, Georgia, was black, as was defendant Timothy Tyrone Foster. And after Lanier got through picking a jury of Foster's peers, all the jurors were white. So was the victim.

quote:

lawyers obtained the prosecution's notes that revealed prosecutors' focus on the black people in the jury pool. In one example, a handwritten note headed "Definite No's" listed six people, of whom five were the remaining black prospective jurors.

quote:

The only issue before the justices on Monday deals with the way this particular jury was put together. Lanier, who did not respond to requests for an interview, has consistently denied any intent to discriminate, and the state argues in defending his actions that prosecutors actually wanted a black juror to avoid defense accusations that the jury was a "white lynch mob."

But Stephen Bright, a veteran death penalty lawyer who is representing Foster at the Supreme Court, said evidence of a racial motive is extensive and undeniable.

I agree. Why do they have to have black people. Seems suspicious.

So you have judges that aren't okay with majority white juries when the defendant is black because it's not truly representative of his peers....

Now you have an all white jury for a white defendant, and it's racist....

Not surprising.

Foster said he was just out to rob White's home, but things got out of hand when she grabbed a knife and chased him around a living room chair. He picked up a fireplace log and hit White hard enough to break her jaw. Then he sexually molested her with a salad-dressing bottle and strangled her to death.

Other than his attorney, I don't know of anyone defending him. I think he deserves everything he gets. Even in the most heinous crimes, the legal system must be

That balance/scales shite is a joke. Its anything but balanced because many other factors always have to weigh in.

Trials must be as fair as possible. We just can't pick and choose which trials are to be more or less balnced

In some cases, there should be no trial

In cases where a confession is given, they should only have a hearing to determine if the confession is admissible. After that it's guilt and sentencing.

It's not. 9-0 decision on that point.
Don't know if it's enough to reverse or whatever they're asking for, but you cannot do what that prosecutor did.

Nothing confirms that your position doesn't hold any merit more than the use of the race card. Nothing.

I honestly don't blame minorities for using it, it's been effective. I blame weak minded people for accepting it as rational. It is 2015 after all...

Oh, hey, you seem to have forgotten this part in your cherry picked excerpts:

quote:

White had the misfortune to use her bathroom in the middle of the night. Only when she returned to her bedroom and turned on the lamp beside her bed did she notice Foster in her living room, according to Foster's confession to police.

Foster said he was just out to rob White's home, but things got out of hand when she grabbed a knife and chased him around a living room chair. He picked up a fireplace log and hit White hard enough to break her jaw. Then he sexually molested her with a salad-dressing bottle and strangled her to death.

Foster's trial lawyers did not so much contest his guilt as try to explain it as a product of a troubled childhood, drug abuse and mental illness. They also raised their objections about the exclusion of African-Americans from the jury. On that point, the judge accepted Lanier's explanations that factors other than race drove his decisions. The jury convicted Foster and sentenced him to death.

Awwwwwww poor poor misunderstood child. Although decidedly not a dindu nuffin, as even his lawyers completely abandoned any attempt to defend using reasonable doubt.

Just attempts to garner sympathy by means of saying such fricked up individuals are somehow excused from the consequences of their actions.

I would have agreed if it reeked of a case where it's possible the DA was overlooking the facts to throw a man in jail due to race, but the defense isn't ever ONCE arguing that he didn't do it, or even that police overstepped their bounds in their investigation or coercing an illegitimate confession.

What the guy did isn't in question by anyone.

The entire defense and appeals is based on trying to garner bullshite sympathy for their client.

And all this story is based off of documents that (gasp) the DA didn't want people who have given reason time and again to be a high risk of buying into that bullshite and disregarding the facts of the case for the sake of racial sympathy.

To put it bluntly, the DA is being accused of being a racist because other people are racist and he factored that in his juror preferences.

And here you are, hilariously condemning in a manner that validates the entire strategic viewpoint when your OP suggests that the most important facts in this case are the ones in line with your "whites oppressing blacks" mantra.

By all means, debate the issue of how death penalties don't seem to discourage violent crimes.

But all the comment was is non-PC. And here is your arse wondering if speaking that notion is a fricking CRIME?!

frick your race baiting arse.

Almost makes you miss Afreaux.

If you took half the time you spend here crying about race and actually used it to help the unfortunate you may actually do some good.

1. You upset. And mad.
2. It's not about guilt or innocence. It's about the courts also following the law. As I stated, even in the most heinous crimes, the legal system must follow the law. Follow the law in the courts, then sentence him to death. No problems. A beginning law student knows this.
