re: States Want to Force Online Retailers to Collect Billions in Sales Tax

quote:Per the IT-540 instructions: "During 2017, if you purchased goods for use in Louisiana from outside the state and were not charged Louisiana state sales tax, you are required to file and pay the tax directly to LDR. This includes purchases from catalogs, television, internet, another state, or outside the U.S." So, yes, you can be taxed twice.
If you pay sales tax somewhere else you aren't taxed twice, but if you buy something tax free that is taxable in La then you would owe use tax.

And buying used items is a disadvantage to local businesses. Having a local storefront is a disadvantage to online retailers who aren't as convenient. You could go on.
Bottomline is there are advantages and disadvantages for everyone. Trying to make things equitable is futile
Well said.

that's like the definition of a sales tax
quote:
a tax levied on the sale of goods and services that is usually calculated as a percentage of the purchase price and collected by the seller

frick anything that makes me pay more in taxes

You would owe use tax where you use it. If you bought something online, shipped it to your house in Louisiana, but then take it "put it into service" in Ms then you would owe Ms use tax.
What if I shipped it to my uncle in Alaska?
Do I owe Louisiana taxes since I’m a Louisiana citizen, or should Alaska get a cut?
Truth be known, if I purchase online, it’s the same as if I purchased in person in the state where the product is purchased from. I owe their state/local sales tax, not my own state, since I didnt purchase it in Louisiana.
These people are getting desperate because it’s their own damn fault for selling their own local economy down shite river in the first place. Their city’s land mass is owned by out of state chains, they’ve all but fricked every bit of locally owned establishments in most places, and now they’re trying to get their hands on money that doesnt belong to them in the first place. INSTEAD, what they should do is promote locally owned businesses, and foster an environment that makes it much more friendly and advantageous to consumers to spend their money with them instead.
And see, that’s the real problem. They couldn’t give a rats arse about their own locally owned businesses. They just want dollars, and they are grasping at straws to make up the difference their own selling out to the highest bidder got them in in the first place. Go cry me a river.

No you can't.

Would would still owe the tax where the item was placed into service. Where you ship it to, buy it from, whatever is irrelevant. If there was no sales tax and the item is taxable where it was placed in service then that's where use tax applies.

No because it's already been taxed. Sales tax is paid at the transaction point and use tax is paid when the tangible personal property is put into service. It's not taxed after that.
Lulz. Try buying a used car in Texas without paying another sales tax on it.

When did YOU pay tax on it the first time?

quote:So, I buy a washer and dryer in California, pay local sales tax there, per the law I'm supposed to pay use tax of 9% on that purchase when I use those items in LA. That is being taxed twice. It doesn't say "if purchases are made in no-sales tax states", it says, if no LA sales tax was paid, use tax is due. That's why I said "You can be taxed twice", i.e. it is possible.
No you can't.

You're misinterpreting.

Plus, the no sales tax on internet sales, puts you local business owners at more of a disadvantage which can also harm the local community as they start to go out of business.
Then maybe the businesses should adapt.

Ok fine, will LA lower sales tax or keep raising them? They will keep raising them and collect on all of your purchases.
So yeah, frick them.

Well actually, as of now, they are going to be lowered in June.

Why shouldn’t they?
If you bought candy at a convenience store in Arizona but lived in Louisiana, would you feel like you needed to pay Arizona's tax or Louisiana tax?
I think we should have to pay sales tax by the state it's located in. Louisiana is riding the coat tails of better economic states because of things like this.

Yeah as of now, but I'll bet that changes. No way a democratic governor lets tax rates go down

They should tie sales tax rate to the credit card and it automatically adjust when shopping online. We already have to put zip code in sometimes when purchasing.

The law currently on the books is actually pretty good. People just don't pay it.

Well that's good. I was just saying, having this in place won't keep them from finding away to get more money out of US. They will with or without it.
And as far has the sales tax rises over the last decade, consumers don't know shite. They go to a local business and think the businesses prices went up, they don't return. When in fact nah you are just paying the highest sales tax in the country now.

I agree with you that the rates in Louisiana are asinine, but overturning Quill is not a Louisiana issue. 45 out of 50 states have the same exact law, Louisiana just has higher rates.
