re: States Want to Force Online Retailers to Collect Billions in Sales Tax

Once these major corporations decide to pay more than ZERO dollars in taxes, on billions in profits, I'll give a shite about the 5 dollars they didn't get in taxes from my online purchases...

Then the state can take 0.008 as I throw my two cents into how fricking asinine the whole thing is.
Any major retailer who has a presence in the state is already collecting the tax.
Any major etailer big enough to be pushing for this is already collecting the tax.
I could get a frick about the tax on something order from a small company with no physical presence in 49 out of 50 states, especially if it is a small purchase.
Use tax on big ticket items bought elsewhere is understandable.
Tax on a few dollars of cheap toys for my kids just pisses me off.

They do because most of the distributors (Apple, Sony, MS, etc) have physical presences within a lot of states.
Ex - Vudu charges sales tax because Wal Mart has a presence in all 50 states and they are a subsidiary.

Plus, the no sales tax on internet sales, puts you local business owners at more of a disadvantage which can also harm the local community as they start to go out of business.
And buying used items is a disadvantage to local businesses. Having a local storefront is a disadvantage to online retailers who aren't as convenient. You could go on.
Bottomline is there are advantages and disadvantages for everyone. Trying to make things equitable is futile.

If you pay sales tax somewhere else you aren't taxed twice,
Yes, I realize that, but the poster said that because you’re a citizen of Louisiana you owe Louisiana tax, and it makes no sense if it wasn’t purchase in the state, or while you were in the state. If I’m in California on vacation and purchase a product online, and have a home in Louisiana and a home in Mississippi, should I have to pay both Louisiana and Mississippi state taxes? WHO gets to say what taxes I have to pay? It’s nonsense.

Apparently, if you exist in a state, you should pay that state a fee for every purchase ever made anywhere.
It's the only way the state can continue to dole out over $6k/person in wealth redistribution schemes.
Louisiana just passed a $30Billion budget for the year. According to louisiana.gov census it comes out to over $6400/person in the state.
Somehow, I seem to be missing my share of this, how about you Scruffster? Oh that's right, we're the wrong demographic in the "rob from the rich and give to the poor" Robin Hood fantasy that dominates politically.

You would owe use tax where you use it. If you bought something online, shipped it to your house in Louisiana, but then take it "put it into service" in Ms then you would owe Ms use tax.

You were using CA internet at the time and it’s only fair to them that you pay them for that as well.
You should also have to pay a tax to any state that CA gets water from because they are basically using their resources so that you can sit in CA to order something online.
And pay taxes to the foreign country which created part of the computer you are ordering the product on because they deserve the taxes as well.

I don't know the dollar amount of use tax for Louisiana is, but I'd bet it's 2% or less of total revenue so you're just wrong. Most experts use tax is about 5% collectable and 95% goes uncollected.

No because it's already been taxed. Sales tax is paid at the transaction point and use tax is paid when the tangible personal property is put into service. It's not taxed after that.

Screw more taxes.
Needs to be put to a vote by the people as with all taxes.

That makes no damn good sense whatsoever. If I’m in California on vacation and purchase online shaving supplies from Massachusetts and I’m a Louisiana resident, how much tax should I owe? What if I go into a store in California and buy toothpaste, and since I’m from Louisiana, does Louisiana get a cut?
Louisiana resident wasn't the right way to say it, but the state should get a tax on all receipts of sale sold in the state. Idk how you write it or define it, maybe you use the shipping or billing address.

Pardon my ignorance but if I buy a car out of state, don't they charge me tax based on my home location?

Posted on 4/18/18 at 8:36 am to Will Cover
This rule is way past due. I mean a company become the most valuable in the world by getting around sales tax.

Yes, but they technically don't have to. You could remit the use tax on your own.

They're selling a product in the state, they just don't have a brick and mortar store.

I'm not in favor of this but if it is to happen then tax it like I'm there making the purchase in person.
If I drive to Montana and make a purchase in person I pay Montana sales tax. If I buy something using my iPhone from Montana then I should pay Montana sales tax not the tax for where it's going to be delivered. Tax at the rate where the purchase is made.
Hint: I used Montana as an example for a reason.
