I was racking my brain, as well. Only two situations came to mind, and only one is mildly defensible:

1) Was out at a party, kids were staying with friends/family, and he picked them up on the way home.

2) Removing the kids from an active domestic violence situation or other very serious threat.

What i understand now about DWIs is that it doesn’t matter if you don’t say anything, refuse the field sobriety, and refuse the breathalyzer, the officer submits for a judge to sign a warrant and then they just do a blood draw whether you want to or not and then you go to jail.

So even if they don’t have evidence, they will have garunteed evidence from the blood draw.

Usually a judge will only issue a warrant if there was a crash.
