The fact that you're more concerned about the validity of what the cop told you and not your son's behavior speaks volumes.

That's what the first cop said. He said he understands because he used to ride 4-wheelers and dirt bikes when he was younger, but it is illegal, and all it takes is one person to complain.

I see people riding 4-wheelers on public roads quite often. Wonder what's different about them. It's a head-scratcher!

Who owns this field/wooded area? I can’t stand when people ride on my land without my permission.

He's a straight-A student who scored a 29 on the ACT as an 8th grader. He's never had a discipline problem in his life, always yes sir/no sir. So yeah, I'm not too concerned about his behavior.

Re the statute you cited, it very well may be that your situation does not meet the elements. The cops don't give a shite about that. You could easily be charged then have to go out and hire an attorney to fight the charges.

Notwithstanding the statute, your son could get hit with multiple moving violations and that's another fight neither you nor he need. You're already on the cops' radar. Just my 2 cents.

Either you’re lying or your son is not from your seed.

Just start recording, tell the cop you are a sovereign citizen and your kid is travelling. That should clear it up. Or take your kid to the Miss bridge to ride because it's ok there apparently.

Regardless, RS 32:416 that OP quoted reads:
quote:

§416. Unlawful operation by persons under the age of seventeen; parents responsible

No person shall cause or knowingly permit his child or ward, under the age of seventeen years, to drive a motor vehicle or a power cycle upon any public road or highway unless such child or ward is licensed by the state to do so

So maybe not the exact statute that the officer cited, but allowing your kid to drive a 4 wheeler on the road then trespass with it is 100% illegal.

It's the property of a church we attend. The pastor said he can ride there anytime he wants. Problem is, it's like 1/3 mile up the road and he would have to push it the entire way, and a 500+ lb. vehicle isn't easy to push.

You are right back then if the cops came to the door saying a person's kid was breaking the law with one of their toys there would have been hell to pay and the kid might see the 4 wheeler again when he turned 18. There would be no second time.

Again, I'm not debating the rule.

If you aren’t debating the rule and you know your son is breaking the law, why are you concerned with another law also? How about just not let him break the original law you understand and then neither of you will get in trouble?

If you have another angle I’m missing, you shouldn’t.

sounds like OP came here to be told how the mean old Po-Po is picking on his honor student kid and that he shouldn't have to obey the rules like everyone else, and when that kid grows into an entitled slacker he'll blame it on boomers

I’d probably let my son at 14 take my truck and trailer 1/3 mile down the road to ride, but I don’t know your kid.

Why don’t you just do that for him?

Sounds like it’s time to donate a new shed to the church!
