Look, he agreed to pay me money, and then didn't. He drove the truck around for 30 minutes and decided he wanted it. It had a lot of performance goodies that could severely damage the truck if they weren't used properly, and he ended up taking advantage of them. He screwed me and then himself.

Btw, I told him everything that had ever gone wrong with it and everything that had been replaced both over the phone and in person. The truck was a lemon, put me $30k in the hole, and he made the decision to buy it. Not my problem

small claims court beckons.
He is going to lose. Maintain composure and have nothing to do with him. No debate. No interaction.
If you are summoned, go, because you are going to win.

I once sold a set of golf clubs to a lady at a garage sale that I had. She said that she was looking for something to get her husband off the sofa and walking while playing golf would be perfect. I agreed, and sold her the once or twice used set at a reasonable price.

Unless her husband was a left handed woman, he was going to have difficulty learning to play golf with those clubs.

Buyer beware!

Buyer beware? Does Louisiana have any laws regarding this? Do lemon laws apply to private buying/selling? In Georgia when you sign the title it's done, unless there's is something in writing.

Lemon laws only pertain to new cars, not old ones.

This thread is the exact reason why the layman is not supposed to be giving legal advice.

IDK all the specifics but chalk this down as a learning experience.

Always emphasize that the sale of the item is being sold 'as is'. Even have the term 'as is' notated on the bill of sale.

Every vehicle I have sold(which is not many), I have emphatically stated to the buyer that this is being sold 'as is' and I am not responsible for any issues or warranties.

Exactly. Always make sure it is perfectly understood because you have no idea what the buyer does to the car when it leaves there. I can rip a transmission out in 30 seconds if I wanted to.

Private party used car sales are automatically viewed as "as is" by the law.

Yes, but it would still be smart to clearly and emphatically state to the buyer that vehicle is sold 'as is' and make sure that both party's are clear on that.

That's it. A valid waiver of a warranty must be clear, unambiguous, and brought to the attention of the buyer. Also, the courts are sometimes ridiculous in their attempt to protect the consumer; however, I like that they try to protect the little guy sometimes.

Just because these redhibition claims aren't brought, and your ratty arse as-is statement isn't busted to shite, doesn't mean that your protecting yourself under the laws of sales or general obligations. Generally, it's just not feasible in everyday situations.

Please don't let your friends give you legal advice when it counts, people.

Not sure what your link is in reference to but this is pretty specific.

quote:

Private sales usually are not covered by the “implied warranties” of state law. That means a private sale probably will be on an “as is” basis, unless your purchase agreement with the seller specifically states otherwise.
