Police blew up an innocent man’s house in search of an armed shoplifter. Too bad, court rules.

The city refused to compensate the Lech family for their losses but offered $5,000 in temporary rental assistance and for the insurance deductible.

Now, after the Leches sued, a federal appeals court has decided what else the city owes the Lech family for destroying their house more than four years ago: nothing.

All this over a shoplifter and

The suspect, Robert Jonathan Seacat, had stolen a shirt and a couple of belts from a Walmart

Cops don't become cops because they're smart.

THIS specific ruling is correct, but i have to wonder under what other theories did they try to sue?

they're lucky those genius cops didn't call CPS and arrest the parents for this grave crime

So you want the city to pay for everything instead of paying their insurance deductible and housing while it's fixed? Why? They have insurance, let them use it with no out of pocket.

We need to get rid of SWAT units. If you give these guys toys, they're gonna use them. And citizens end up getting fricked.

That sucks but ultimately the civil liability for the damage is actually on the suspect in this case.

Unless the cops are paying it out of pocket, that's just teaching the tax payers a lesson, no?

Why?

Bc they're entitled to become whole again and I'm betting the 5Gs wouldn't make them whole.

Insurance company should be left to sue the city for compensation.

The lesson to be learned here is clear.

Don’t shop at Walmart.

You do realize that on a total loss depending on the amount that homeowner will never get ins. Again.

My inlaws home in Lafitte burned down. They puchases another home and my FIL couldnt put his name on the title so they could get a reasonable ins policy.

Morris Bart has taught everyone that an unfortunate circumstance is always someone else’s fault (not that it isn’t in this case) and you should always get a HUGE check. People aren’t happy with getting a fair settlement these days. They want it all.

The Lechs had sued under the Fifth Amendment’s Takings Clause, which guarantees citizens compensation if their property is seized by the government for public use. But the court said that Greenwood Village was acting within its “police power” when it damaged the house, which the court said doesn’t qualify as a “taking” under the Fifth Amendment. The court acknowledged that this may seem “unfair,” but when police have to protect the public, they can’t be “burdened with the condition” that they compensate whoever is damaged by their actions along the way.

Well, that is some bullshite.

Are we really THAT much safer than when the local sheriff was handling things rather than a militarized police force going around blowing up the wrong houses over a shoplifter?

I mean, come on, there has to be some appropriate reaction and accountability for these things.
