So you want the city to pay for everything instead of paying their insurance deductible and housing while it's fixed? Why? They have insurance, let them use it with no out of pocket.

That sucks but ultimately the civil liability for the damage is actually on the suspect in this case.

You do realize that on a total loss depending on the amount that homeowner will never get ins. Again.
My inlaws home in Lafitte burned down. They puchases another home and my FIL couldnt put his name on the title so they could get a reasonable ins policy.

Morris Bart has taught everyone that an unfortunate circumstance is always someone else’s fault (not that it isn’t in this case) and you should always get a HUGE check. People aren’t happy with getting a fair settlement these days. They want it all.

The Lechs had sued under the Fifth Amendment’s Takings Clause, which guarantees citizens compensation if their property is seized by the government for public use. But the court said that Greenwood Village was acting within its “police power” when it damaged the house, which the court said doesn’t qualify as a “taking” under the Fifth Amendment. The court acknowledged that this may seem “unfair,” but when police have to protect the public, they can’t be “burdened with the condition” that they compensate whoever is damaged by their actions along the way.

Are we really THAT much safer than when the local sheriff was handling things rather than a militarized police force going around blowing up the wrong houses over a shoplifter?
