So the witness should have seen the entire event in person, including the shooting based on what you are saying. Funny, the witness doesn't say that, only that he heard arguing and fireworks or gunshots.

I disagree. The defense can show that easily if that's the case. The question, assuming Smith had and drew a gun, is whether this is murder or manslaughter. It isn't self-defense when you chase somebody down and draw a gun. The defense of property is not justification for creating this kind of situation.

A video has been released by someone. Not sure if it is the video that NOPD didn't want released. WWL got a video and it is out there now.

If I provoke a gun owner, they anounce they have a gun, I shoot them and kill them, but never see a gun, that's justifiable homicide?

What if the other person pulls their gun first, and you are pulling your gun in response? You still think the first guy that pulled the gun is justified simply because you were going for your gun to protect yourself?
