it's at 7 second mark he says "and finally he's out GET OUT OF (something... car maybe) I have a gun" and then he's like frick ya'll i got one too and starts shooting"

yea, that's exactly what he says.

tells me Hayes didnt even threaten Smith with a gun up until then. Not unti Smith threatened him with his own weapon that Hayes pulled his.

no, half his body was slumped in the car, and his feet were still on the cement. Not saying he was reaching for something but with the way they found his body, half in car, half on ground

Open..Shooter shot from outside the front driver side door towards the vehicle..One of the bullets hit Smiths wife sitting shotgun. You can see on the passenger side front door where a bullet hit the door from the inside.

you act like the situation started at that point


either way, if Smith said he had a gun and was reaching for it, Hayes was obviously threatened for his life.

going by your own theory Smith didnt know Hayes had a gun. Smith was the first one to announce he had a weapon. This is according to the material you are going off of.
