Even Will Smith having a gun isn't that relevant. Where as the gun? Did Hayes know he had a gun as opposed to Smith just talking shite?
He has to have a reasonable belief that he is in imminent danger, and he can't have been the aggressor.

witness said hayes was freaking out on will and specifically stated something about we want to fight you (will smith). That's when will said GET OUT OF CAR(something), i have a gun. (meaning he was feeling need to protect himself, that's when hayes said frick ya'll i have one too... bang bang bang

i'm only said what a first hand witness said. You have assholes in here cherry picking lines from witness without portraying whole picture of what witness said.

If you're getting into with a dude who says "I have a gun" and then he starts going through their center console/glove compartment/etc., wouldn't that lead to a reasonable belief that the guy is going to imminently produce a weapon?
Not saying that's exactly how it went down. Not saying that's enough to claim self defense. But If I'm getting into a shouting match with a dude I just into an accident with and he says "I've got a gun" and then goes back to his car, I think it's a reasonable assumption that he's coming back with his gun and not his insurance information.

Sorry Chad. I didn't direct my post just to you. It was to everybody that has already formed some type of conclusion either way based on supposed eyewitness accounts that are so poorly worded.

Regarding if Hayes was "freaking out" on WS, has it been confirmed/determined which one had his shirt off prior to the shooting during the altercation...I read where more than one witness reported this...to me, that might indicate someone is "freaking out" if he tears off his shirt.

I'm thinking that law would vary by state. You may be correct. But I doubt you know LA's laws concerning self defense with deadly force laws.
