Was the guy traveling when he was stopped by the cop? How can the cop prove he was driving?

I looked this up after watching the video. Only thing I can see is he is referring to this "presumed" speed limit law Texas has. You can apparently argue in court that even though you were doing 40 in a 30, you were still driving safely given the driving conditions at that time. You can have the ticket thrown out. Doesn't mean that you can refuse to accept the ticket, or refused to be detained by the officer.
I loved the "do you have a warrant" comments. Because an officer needs a warrant to detain or arrest you
. "Oh shite, that guy over there just shot that other guy, let's go to a judge and get a warrant to arrest him. Because otherwise, what right do we have as men to arrest other men?"

I've been stopped by the officer in the video lol... Pretty nice guy and I took my ticket without a beat down.

This is correct, in theory. Speed limits are prescribed by local entities and the Dept. of Transportation. Prima Facie speed limits are how it's done in Texas. But just because the speed limits are prima facie doesn't make them unenforceable.

Just watched on my phone this time. Good Lord that driver was a tool. Also it sounded incredibly apparent that he'd been drinking. My favorite exchange was "the D..The DA..he has said that when...the DA said...oh cmon you know? No, it wasn't the DA it was the...it was, the prosecutor! Yeah the prosecutor said that in the staaate of texas, speeding in and of itself isn't illegal"

A lawyer is not involved here. But the cop was very patient with this citizen.

Everything the "lawyer" said was actually correct. Just saying.
ETA: the cop had really no reason to bust his window out either. Should have called the supervisor, frankly. Now he's in a shite storm of a legal matter for no reason.
That said, the "lawyer" was an arse. You were speeding. You knew you were speeding. Hand over your license and registration, take the ticket, and fight it in court if you want. Now, you have a busted out window and a lawsuit against the city. Have fun with that.

No he wasn't correct. He was traveling at a speed I excess of the posted limit. The cop felt it was unsafe and pulled him over. At that point the cop had reason to stop him. If that's not the case, then you're saying everyone can drive 100 mph because police do not have authority to pull you over. When he refused to provide identification, the cop had probable cause to detain him. Then when he refused, you get borderline resisting arrest.
