In California the employer has to pay 100% on the day of termination.

Sounds like you work in healthcare if they are paying out less than 100%. They are the only douchebags I know that do that

Worked at a place that had to make a rule that all PTO had to be scheduled in January for the year... Because some dumbasses screwed around and had PTO left in December and caused a lot of trouble with scheduling.. And if you had to change some of your PTO it better be for a death in the immediate family...

Depends on the state.

Texas does not require employer's to pay out.

When I quit my last Texas based job, I used up all my PTO right before turning in my notice. They got a little pissy about it but I just laughed, as that's essentially what any rational person would do as a result of the policy they chose to write.

Yep. La. If they offer it. They have to pay you for it. Thats why a lot of companies went to accruals. And made a use it or lose it. If they don’t accrue, and you have 3 weeks per year, you quit Jan 2. They owe you for 3 weeks. Accruals are there now so they do t have to pay you

If its time that you earned then i'm pretty sure they have to pay you for that.

I get 200 hours Vac as well. if I'm not feeling it, I can call in and take Vac if i want. I haven't used Personal in over a decade.

Mine is supposed to be 100% of time accrued, but I'm sure if they can screw me they will.

I just switched jobs and they paid out all my PTO (vacation, floaters and sick)

Spoken like a true HR manager.

Truth is my guys are salary and sometimes work late and some weekends in instances. That unbudgeted liability is an outrageous claim. There are office workers who are 9-5, then there are operational staff that you have to hire correctly that will take one for the company if the company works with them on what they need. With that good staff, that is taken care of, is a staff that takes care of the company.

Nannying people and not treating them like adults is a good way to drive away talent, at any pay point. You also have to get on idiots that try to take advantage of it. It’s not that hard.

A European vacation….what kind of idiots do you have running that place? Fire them if they pull that stunt.

Sure you can burn it, but you have to be approved and get your job done. You guys act like its super easy to just use it.

I would suggest that any company that routinely has massive amounts of employees with huge PTO balances should consider other forms of compensation and time off. Maybe more holidays or something like that. It really makes no sense to anyone to do this.

As said, most companies that have accrued PTO will have a handbook or have this written down somewhere. That's the place to look. I own a small business of under 15 employees and I have it written down, simply because everyone tends to ask when they are fired, quit, etc.

PTO is simply a paid financial benefit. There's other ways to give time off, paid benefits, compensation, etc.

Just left an employer where we max out at 400 hours of vacation. We also get personal leave so I always used that and saved the vacation until I got more at the beginning of the year and had to use it to get back down to 400.

I'll be getting 5 paychecks worth of vacation soon.
