My understanding of the open container/possession law is if it is accessible then it can be linked to you. If you have a half bottle you are taking somewhere, put it in the cargo area or trunk and no one says shite to you if you aren't facing a DUI.

Another understanding is in Alabama, I know, they can hit you for open container if it is a six pack not in a bag or a box of beer that is opened. It is supposed to be in a "closed container" of sorts. i always insist on a bag to put beer in leaving a grocery store if it is a six pack to cover my arse.

The task force guys know every single little miniscule law.

Ex: When you are turning right, you have to stay in the right lane after the turn for something like 150ft. I got pulled over one night because my license plate light wasn't bright enough for the cop to see(didn't matter that it reflects like the sun when you shine headlights on it). No seat belt? Doesn't matter if they are 1/2 mile away in the middle of the night with no lights anywhere. Their x-ray vision can see everything and you will be pulled over no matter if you were wearing it or not

If you notice every DWI, they are required to give you two tickets + DWI. Bet your arse one of them will be either careless or reckless operation

Field sobriety tests? Purely at officer's discretion. You can pass every single one according to 99.999% of earth's population, but that cop will say you failed and were drunk.

The task force has competitions on who can give the most DWIs each night. I have 5 friends that were not drinking, who all got them within 10 minutes of each other on Corporate. Cases were dropped, but of course it cost them $3500 and a night in jail


Eta: That was probably 5 years back when BRPD was trying to extort the owners of the Cove to hire off duty patrols. Didn't want to say it, but I will. My buddy drove us home because I was drunk. We came out, saw the cop sitting there, made a LEGAL u-turn, and got pulled over at that gas station on College.

He drank two beers(6'2 275lbs) and the cop gave him a FST. Sho nuff, the cop said he was drunk. Cop then told me to get my stuff out of the truck because they were gonna tow it. I argued with him for about 5 minutes, and he decided I could drive home if I passed the FST. Keep in mind that I had probably already drank an entire fifth of Jack. Yup, he said I passed and let me drive home.

Took buddy to the DWI bus, and he blew something like a .01, and the cop told him he was free to go. Now I guess he thought I was stupid enough to drive my drunk arse to the DWI bus, because he told my buddy to call me for a ride. No way was I gonna do that, so he had to take him back to my house. Cop drove up about 45mph, slammed on the brakes, opened the back door and pulled my buddy out, slammed the door and sped off. Not a word was said

It is a major racket

If marijuana is legalized you can bet DUI/seatbelt checkpoints will go way, way up.

Gotta cover the holes in the budget somehow.

Do you actually take your liquor or wine home with you from a party? You cheap frick, I bet your hosts just love you. Do you stuff a few finger sammiches in your purse on the way out as well?

That's probably in case you didn't see someone coming. Gives them a way out in that they can go around you- as opposed to being across the two lanes.

That is because they must have a reason to suspect you are driving under the influence.

No. The rules the OP described have been around for decades and are taught in driver's ed. If you have an open liquor bottle in the trunk or bed, you're good to go.

I probably have a half fifth of crown in my truck stuffed under the seat from tailgating last year...

SUPER true. When I was in high school, I was riding around with someone who got pulled over for speeding. In the back seat was a bag with a half-empty bottle of vodka they forgot about. Open container ticket.

Really, 9/10 if you just act normal and be civil with a cop, you could have a dozen half empty bottle in your back seat and they will just wave you past at a check point.

I have been pulled over a handful of times late at night for minuscule (aka bullshite) reasons, and each time the officers admitted they were really looking for drunk drivers. BTW, I have never been ticketed for any of the stops. They just made sure I wasn't drunk and sent me on my way.

There are no state laws in Tennessee against a passenger possessing an open container in a vehicle. Municipalities can pass ordinances against it but the maximum fine is $50. So if you're road tripping through TN and not driving crack one open.

Unfortunately, I've had this happen to me before.

Years ago, I was taking a bottle of Armagnac to a friends house on Highland when I was pulled over for having a tail light out. I was driving a 1995 Jeep Cherokee and he saw the bottle in the cargo area as he was writing my ticket.

Long story short, he dumped out my $150 bottle on the side of the road and I had to take off a day from work to contest it.

Well actually, I was talking about taking my own bottle since I enjoy really good bourbon and don't like to depend on my host to supply that. Not sure how that makes me a cheap MF but I forget that this is the OT where people feel beholden to show up and shite on the OP with some unrelated BS.
