This is more of what I was referring to.

thirty years without interruption, within visible bounds, more land than their title called for
And "within visible bounds" means "fenced" to me... not just mowed or picked up the pecans over there.

162. Suspension of acquisitive prescription
A cause that suspends the running of the prescription of nonuse applicable to mineral rights has no effect on the accrual of acquisitive prescription in favor of one possessing the surface of the land as owner insofar as his possession may include mineral rights. However, if an obstacle to use of a mineral right is created by an adverse possessor, the accrual of acquisitive prescription as to the right is suspended in the same manner as the prescription of nonuse.

"Psycho Coon arse Property" sounds like a nice mixed use development. Is that a Tommy Spinosa venture?

I developed a subdivision once and there was a lady that had installed her sewer system onto the land I had bought. The incompetent parish sanitation dept didn't want to deal with it because it was their screw up too for signing off on the permits for it.
I could have dug it up and dropped in on her property had I wanted to. Instead of dragging out any legal dealings I just cut that part out of my subdivision and sold it to her for 25% above appraised value. She still came out ahead vs having to relocate the system.
The bad thing is I owner financed it for 3 years and 7 years later she still has not paid it off. She has paid me almost triple in late fees and penalties vs what the property is worth.

Must be possessed for 30 years without interruption
So False Prophet esquire... every time a new survey occurred and someone new laid claim does that constitute interruption?

I would say the ditch, according to his sketch, are the visible bounds. whoever dug it knew where the property line was

Did you explain why you are cutting down the Pecan trees?
Posted on 10/8/14 at 10:57 am to Chicken
I'm cutting them down as to build a shop and place a fence along the property line

I have no idea, and I don't have full knowledge of the facts of the case.
If Redneck neighbor's account is true that his family maintained those trees since he was a child, I'd think he'd have at least a colorable claim, regardless of the latest survey.
ETA: And why the sarcasm? You haven't posted anything that's remotely correct in this thread, and you're mad that I called you out on it?

The ditch is a parish servitude

Even if he leaves them up, the battle over ownage is still there.
The guy obviously believes they are his trees on his property.

Have the property resurveyed.

But wouldn't they have to actually at some point in time file their claim to it?

This dude never owned the property the trees were on.. From what the cops stated to me he used to play around those trees as a kid or something and pick pecans with his dad. He's a loose nut.
Now we have the heart of the problem. Dude has sentimental attachment to the trees.

Whoa there big fella.
That's all yoU had to say.
Although some pecans on your property are a terrible thing to kill senselessly...
