This video is from 2013 and might have been posted here before, but I just want to ask. Is this situation a representation of what puts most people, who are shot by the police, in that situation?

I don't get giving the cops a hard time at every damn opportunity. If you were speeding you got caught...take the ticket. No need to frick with a man doing his job.

She turned a minor inconvenience into a major conflict.

I didn't watch the video but I do know they have to have probable cause to justify something like forcing their way in to your phone.(since it's like forcing their way in to your home) There's another video out there with some guy who shows how to get pulled over and not get out of your car by handing shite out the window, keeping your hands on the wheel and not having anything suspicious in the car.

The answer is irrelevant though. She rolled her window up completely, and it looked like when she cracked it again she tried rolling it up on the officer's fingers. She was completely out of line from the beginning. Nothing should happen to that cop.

I'm all for exercising your rights, but anyone with some common sense knows when confronted by a police officer you just say yes sir and do as told.

I've had my rights violated numerous times growing up, yet somehow I'm still alive to talk about it. Everything is about weighing risk vs. reward. When dealing with cops the risk of pissing off the cop far outweighs the reward of "exercising your rights".

It sucks but that's the way it is.

I dont get it. Is it so hard to listen to what a cop request? hell most of the time he'll explain why he pulled you over upon walking up to your car. Most of the time we already know what we did but sometimes i need clarification but i'm respectful when i do it.

Do you think I am trying to stir things up? Absolutely not. I think its worth having the discussion as to whether or not the problem originally starts with someone not complying.

And as for as someone asking whether she has to roll down her window or not.. Seriously? First of all, how hard is it to roll down the window all the way? You have to consider what police deal with all the time. They can't just assume someone is not a threat. Why would she not want to roll down her window? Is she hiding something?

link to an leo forum on this very topic ... posts are several years old, but some of the comments are interesting ... no definitive answer on whether or not it's legal to refuse to roll down a window ... assume it falls under 'failure to comply' ... one guy said he just starts talking as softly as possible until the person rolls down the window ...

Please roll down your window is not a lawful order in Florida. However, according to the Supreme Court, he did give a lawful order once he asked her to exit the vehicle.

He could have slipped the clipboard through the crack, and then chose to escalate the situation because she wouldn't roll the window all the way down.

Yes, I think most encounters with police will go smoothly if you treat them with courtesy and respect. Nevertheless, he is supposed to be the professional and should be able to calmly handle a situation like that without it having reached the point of breaking the window.

Now, I will not excuse her actions of locking herself in the car. That was childish and uncalled for. At that point I understand why he broke the window and detained her.

No. BUT, an officer CAN ask you to exit the vehicle for pretty much any reason. Usually, it's because the officer has suspicions or for personal safety.

If you're not going to comply with a simple request from an officer, fine. But you need to be prepared for the lawful repercussions.
