Physical pain vs. Emotional pain

A person can get arrested and jailed for physically hurting or injuring another person.
However, if a man or woman cheats on their spouse, there is no arrest or jail time.
An argument can be made that the emotional pain of being cheated on, especially if you walk in on your spouse cheating, can linger and have much worse side effects, than physical pain.
Should a man or woman be arrested for cheating on their spouse? Should there even be jail time, or at least community service hours?

Emotional pain/suffering is against the law in some cases. Bullying and Stalking are two examples I can think of.

pain is a physical sensation, theoretically objective to some extent
suffering comes from your own response to a stimulus, like an insult, betrayal, or physical pain.
Suffering originates within you, and therefore is under your control. Its not easy but if you are in control of your mind, you can end it regardless of the stimulus that caused it.
Achieving that level self mind control requires thought, practice, and having a guiding philosophy of life.
It would not make sense to arrest someone for what is happening in someone elses mind.

Psychological pain can manifest itself in a conversion disorder resulting in very real physical pain. Can be much more difficult to treat.

I'd say something like having my stomach/intestines pulled back up into my esophagus via a partially digested rag that's also hanging out of my mouth, then slowly bleeding out internally would be worse than witnessing some consensual sex that I'd frown upon, yeah.
