Good luck with that
Only need 1 other old or infirm person on the jury.

Guaranteed if someone is gonna spit on me they will also at least bleed on me too when all is said and done.

And all you’d have to do is list/show the cases across the US in which people have been arrested and are being prosecuted for terroristic threats and battery for doing it.

I think you missed a day of Law School if you think that's a defense

Could you actually imagine hearing this as a defense strategy? I’ve actually been laughing out loud that this is actually being legitimately discussed. I thought this was a troll thread.
Lol this is the funniest thread I've ever been a part of.

You are missing a key component of justifying lethal force. Imminent danger is the standard used to determine if lethal force is justified. Killing someone who coughs on you is not placing you in imminent danger.

Depends on how you feel about this virus. You could argue if you’re out in public, unprotected, then you do not “reasonably” fear the effects of the virus.

However, a 10% or higher mortality rate for this virus in people with weakened immune systems, that’s a reasonable threat. Is it imminent? Since there is no treatment or cure, it could be viewed similar to a poison or some other non-immediate but highly lethal “attack”.

I’m not saying lethal force is justified, but in the right set of circumstances, there may be some arguments. A highly susceptible person, taking reasonable means to protect themselves, is attacked by a person clearly and definitely identifying themselves as COVID-19 positive, with the malicious intent to infect them. Provided there’s no other reasonable means of restraining or stopping the attacker.

I think you’re a fricking c unt if you don’t think a good lawyer couldn’t find one elderly person or one with pre-existing conditions that would sympathize...

And anything can be a defense. The fact that people doing the exact thing are being charged with terrorism is relevant to this scenario.

Why don't you go and do it and report back to us with the results

I never claimed I would shoot someone, just the fact that it could potentially be justified in this climate.

Why don’t you go suck on a shotgun barrel

If someone's chasing me, as specified in the OP, yeah in the moment I'm going to take that as imminent danger.

If you don't want that kind of response maybe don't chase people down while coughing at them

You would probably have a better argument about them chasing you and fearing great bodily harm from physical violence rather than chasing and coughing on you.

Or, just fire away and keep us posted on how the trial goes.

Intentionally? Yeah, someone who does that doesn’t need to live in our society. A purge may be needed.
