David DePape, Big scary looking guy in his underwear wielding a hammer is in the home. We are to presume this is a home invasion and he is dangerous, yelling acting crazy.

ETA: DePape stated he was going to break Nancy's kneecaps.

DePape allows Pelosi to go to a bathroom to call the police, who he tells the guy's name and that he is a friend.

Police arrive.

Pelosi opens the door for the police, then walks several feet away from the police back towards DePape.

Then the attack happens.

So, the situation was serious enough to warrant calling the police, yet he was allowed to call the police, who he told DePape's name and that he was a friend, and allowed to let them in, but then he doesn't seek refuge or protection from them or move away, but actually goes back toward the crazy huge underwear hammer guy.

Defendant tried to pull the hammer away from Mr. Pelosi, which twisted Mr. Pelosi's arm back. Simultaneously, Mr. Pelosi pleaded, "hey, hey, hey!" The officer asked again, "what is going on here?" But Mr. Pelosi could not maintain his grip on the hammer. A second later, Defendant wrenched the hammer away from Mr. Pelosi, immediately stepped back, and lunged at Mr. Pelosi, striking Mr. Pelosi in the head at full force with the hammer, which knocked Mr. Pelosi unconscious
