If negligence is found on the part of SWA, and everyone decides the payments they dictated should be sufficient, that is the moral hazard.

I see nothing wrong with someone initiating a suit to bring to light any negligence on their part.

And my post was also more general, since so many in here seem to think you're a piece of shite if you're involved in a deadly incident and sue the offending party if you survived.

see above post re: UAL 232, it's been tried, and appealed, unsuccessfully, shite, pro baseball teams/stadiums have no liability if a lined foul ball kills a baby, an assumed risk

Well, they weren't physically hurt and they didn't suffer any financial loss, so I think someone handing them $5K each is a pretty damn good day.

yep, and the wink link is the judge and/or a jury if it's a jury trial, SURVIVOR may have cause, but why should the survivors of the deceased hit the lotto?

Would it make you feel better if SWA had to pay them $100 million and they proceeded to burn the cash in the street? SWA must pay for that life. Not sure if you disagree with that or just mad that someone gets the money.

just as I don't care if someone inherits $100MM or wins it in a poker game, I'll never get why the survivors, or courts, for that matter feel that that type of compensation is deemed appropriate, she's gone, condolences, who places a price tag of 100 mil(just using your figure for discussion,) on that life? and who is it owed to? she certainly would never have accounted for that much wealth accumulation/loss of income to the family being a Wells Fargo VP

didn't say that, and I believe you're an attorney, so this could go on to infinity, so in summation, ah hum, jk, just don't see why this is a lottery winning scenario, there are assumed risks, funeral burial costs, maybe a couple of years of bridge the gap replacement of her wages(which wouldn't be taxed,) throw in a 100k of pain and suffering and I think that's is above and beyond

I'd take the money... shite we are too damn sue happy, it was a freak accident no fault of the airline and the pilot made sure most people lived.

There was a passenger from England that survived the Delta 191 crash at DFW in 1985, he was interviewed about 20 years later, and he was living and working in Dallas. He had never returned home to England because he refused to ever fly again, and didn't have the time to go by ship.

The airline then has insurance for freak accidents.

That is why I mentioned that these guys are fighting for the billion dollar insurance company to not pay out rightful money. It's glorious

I hate people that sue for things out of someone's control. Suing should be reserved for when the insurance company wants to frick you.
A 6 figure settlement plus funeral expenses should be enough for a freak accident. Instead we have people wanting 7-8 figure settlements.

Pretty sure united, mcdonnell douglas, and alcoa paid out an undisclosed amount.
This chicago tribune article says 211 of the 296 cases were settled as of jan 14, 1992. Sounds like the majority won. Here's an article from 3 years later settling more suits. Says most of the 296 were settled, mentions no losses and google had no hits for overturns...
