Orleans Parish help - neglectful neighbor's untrimmed tree soon to damage property I own

Need advice OT.

I've a rental property in Orleans, and between my property and the neighbor's, there are some garbage trees originating on his side that need to be removed/trimmed. The root system is about to start damaging my fence, and the branches are starting to rub my soffits and roof.

Never met him, his tenants haven't either. Property is owned by an LLC with a Nola address. Tenants aren't helpful.

What's my best course of action here to get him to handle these trees? I'm not going knock on the door of the LLC's address (residence in bad area).

Is there any enforcement mechanism in Orleans for this type of issue?

I'd probably just trim the trees back myself at least to get off of the roof.

The city will not care. Your solution is to trim the tree on your dime.

You'll need to notify the owner via certified mail of the issue or else in the event the tree falls and causes damage your homeowners insurance will be held liable.

I’ve been told that, if a neighbor’s tree limbs come onto your property, you have the right to trim them yourself.

If it’s private property I don’t know that the city can do a whole lot besides code enforcement. Good luck with that.


If branches are on or touching your property you’re able to cut back what is on your side. I would also make sure to document any communication you’ve had with him notifying him that the trees are nuisance to your property.

I’m also not a lawyer.

All the people telling you to just cut the branches back, may not be aware that the owner can technically come back at you for damages if you do not seek his permission first. Not an attorney, but had one explain it to me when my neighbor's tree branches from his oak tree would hit my car under heavy winds.

I'd send a certified letter, with pictures, notifying them of the problem. I would also provide contact information and tell them that if you do not hear from them within 30 days of mailing, then you will view their silence as their permission to trim the trees back at least 6' from your house.

This is the law:

Louisiana civil code

Despite what others are saying here, you cannot legally cut your neighbor’s tree without their permission.
