I would posit there is an element of hate in all crimes...hard to imagine killing someone without choosing "a victim because of some characteristic — for example, race, ethnicity, or religion — and provide evidence that hate prompted them to commit the crime" (US Department of Justice). Note that race, ethnicity and religion are examples and is not an all all inclusive list. Those on the left supported the idea of hate crimes as a way to make crimes defined as that above more serious than run of the mill crimes of similar nature and those on the law and order right went along with it because it gives the state more power over the individual. In my opinion hate crime legislation is bad legislation and always has been...but it panders to the extremes on the left and the right.

Of course they are...and the reason is abundantly clear why they are...because it is up to police and prosecutors to define a hate versus common crime of similar nature and both groups are over represented by extremely conservative individuals...any crime committed by a black person in this country is apt to be viewed more seriously than the same crime committed by a black person in vast reaches if not all of the nation.

But the interesting conundrum here is. He technically "stole" the flags which is what he should be charged with but given the low cost vs min amount standard to be arrested in this liberal utopia . He wouldn't be charged with stealing. So is he being charged for freedom of expression?

I could care less what or how anyone "believes" anything.
