New Orleans man pleads guilty to killing man he caught burglarizing his father's car

PSA: Deadly force does not apply to vehicles unless you're inside the vehicle and someone is trying to break in and harm you

As John Thomas Jr. stood near the passenger side of his SUV, investigators say his son shot at Battiste while still sitting inside his own car. In the surveillance video, a muzzle flash can be seen inside John Thomas III's sedan, the Sheriff's Office said.

John Thomas Jr. walked back to the bar and spoke to a women before returning to his Trailblazer and fleeing the scene, the Sheriff's Office said. Neither called authorities to report the shooting or seek help for Battiste, who was taken to a hospital and later died.

John Thomas III was charged with second-degree murder and faced a life sentence if convicted. Manslaughter carries a maximum sentence of 40 years in prison.

give this guy 20 years for catching a thief but they can shoot people in the 9th ward for no reason and get 5 years

We should be able to shoot people breaking into our cars without legal repercussions.

I wonder if it changes anything had they called the police immediately after the shooting. I'm genuinely curious if that would somehow lessen their charges.

Yes, but I'm going to follow the law until the law changes.
I'm not going to prison for 40 years over some crackhead rummaging through my car.

The system has been rigged against law abiding citizens. We have everything to lose and criminals have nothing to lose, except for their life, which they don’t value anyway.

Here in-lies the problem.


The handicapped son was the shooter and shot from his own vehicle into his father's vehicle.

Well, it wouldn't have been deadly force if the burglar hadn't suddenly jumped right into the path of the bullet at just the right angle and elevation. It was intended as a warning shot and the shooter should only be charged with "discharging a firearm within city limits."

They have the shot on video. Muzzle flash came from the son's vehicle.
