And those thousands of dollars to defend a bogus DUI? I’m getting that back in the civil litigation using the most bloodthirsty litigator with a grudge that I can find.

And after that settlement comes… I’m parading a blown up check with the payment amount on it around town or the county thanking every taxpayer in person for their entire amounts of multiple people’s property taxes coming to me for their department’s incompetence.

Only to drag it back out in the election year.

Drunk/high drivers suck, but claiming someone is drunk after failing a nystagmus test administered by someone who can't spell "aspirin" is ridiculous.

It’s 100%. When they get to the field sobriety tests they have moved on to the gathering evidence phase. No matter what they say they are not trying to see if you may or may not be drunk.

This is the thing. Regardless if innocent or not you have your license suspended, risk getting fired from your job, etc until the court date which could be months away. All based on someone with a GED and power trip opinion.

Simple, this is a money grab and those people don't / can't pay fines. They instead have to serve jail time which costs money.

So they do these in areas where people can and will pay their fines to make it all go away.

Wrong. Often the breathalyzer reads lower than you actually are, so if anything it would help you. A blood test will show traces of alcohol even 2 days before, so that would be the absolute worst thing to do if you drank or smoked over a couple days.

The roadside breathalyzer is not admissible in court. Anyone telling you that taking the roadside breathalyzer is helpful to you is lying.

Well...yes. I don't want these people on the road, even in the off-chance this person was simply having a bad reaction to medication. These people should not be driving.

As someone who did shift work at a casino, I’ve taken and passed 3 field sobriety tests and been sent on my way each time. “No sir, I’m not drunk, just tired” Being respectful and following directions works. They aren’t all out to get you.

Well I smell weed and alcohol on the cop who pulls me over. Citizens arrest. Kinda like that jerk who interviewed the detective in the parking lot and within a min he was interrogating the detective ( think he name was Dt Mike Jardy?) and had him rattled. I don't like those type guys looking for a problem nor do I like cops that just wanna think everyone is drunk or high.

Did you watch the video or read the original text? Guy had zero alcohol or drugs in his system. Still arrested, spent the night in jail, and took 6 months to clear his name.

Yes, I did. I wasn't talking about that guy specifically. More to your standard-issue baw who will drink a couple and drive. Just not worth the risk. Didn't mean to imply that the guy in the video took a risk.

bullshite. I've blown a 0.04% and NOPD said: Congrats, you're only half drunk, you should drive straight home. I still had to pay the speeding ticket though.

Not true at all. The only time I got pulled over I did the alphabet backwards and walking backwards heel to toe tests and got cut loose. I would certainly not have blown a 0.0 and was likely borderline.

In my state we have “Implied Consent.”
You can refuse a field sobriety test, BUT you cannot refuse a chemical test. Refusing is considered an automatic failure.

Even worse, if you have a CDL, you cannot refuse a field sobriety test, even if you’re not driving a commercial vehicle.

Bruh, 2-3 beers over a round of golf ain't going to put you over the limit. But that slight smell of beer on his breath and his slurred speech from Bell's Palsy would be too risky for him to avoid trouble from police.
