Nope, wrong. It's called an Act of God. OP is on his own unless he can prove the neighbor knew something was wrong with the tree. Live oaks live for hundred's of years.

The problem with old live Oak trees is their trunk core goes bad. Older lady across the street planted one in her front yard the day they moved into the house. One morning 50 years later half of it was in the street.

In Alabama, you are responsible for everything on your own property.

I have been through this twice during storms. The neighbor has zero liability for their tree.

I got got the good end of the deal once and he bad end of the deal the other.

I'm glad your family is safe.


Now go rent a god damn chainsaw and a truck from HD and clear it yourself.

It looks like a lot but will take just a few hours to clear
