We had a similar situation a few years ago when an old oak blew over in a storm and landed in neighbors yard and fricked up his fence etc.

His insurance wound up paying for the fence, but I went over and chopped up the tree with my chainsaw and cleaned up as much debris myself as I could to help out and minimize the cost. Got some firewood of the deal as well. I value the neighbor more than the cost.

In all likelihood both of you would be able to file a claim on insurance. There is a part of three on both pieces of property. If you work together and use the same company to remove both sections it might minimize your out of pocket.

We've been there when our tree fell on a fence and into the neighbors property (almost disastrous, actually- missed going through their roof during a hurricane by literally inches). We both had tree to remove and the fence was on their property. We worked with them and paid part of the cost for all of it to maintain the neighbor relationship.

Actually water oaks can keep their leaves just like a live oak.... being this far south they've become adapted to the climate and become an evergreen only dropping leaves as they get old

The bark and leaves look too light colored to be a live oak.
Water oaks are notorious for falling / splitting.

A water oak has value and is called a red oak in lumber terms. However, I don't know if there is any profit in it for a lumber yard to remove one tree. I doubt they'll pay you for it, but they might be interested in removing it.

On another note, if this tree fell without any storm, it is possible that the owner could have been negligent. Still difficult to prove.

I'm in the lumber business and know for a fact they wouldn't pay to take the wood away....they don't have a way to mill it... the mill wouldn't even come pick it up....

My neighbors live oak fell on my fance and back yard. He and I cut it up, stacked it and then repaired the fence. Cost $300 in lumber and $100 in beer. No problem. Stop being a bitch.
