You do not have to give them 40%. In Louisiana we are free to represent ourselves. If they are not worth it, don’t pay them. People foolish enough to give those attorneys 40% deserve to get fleeced.

The fee is always subject to being “reasonable” even if you agree to 40%. Course they don’t want you to know that.

The part about the 40% that most people do not realize is the medical bill portion. The lawyers want you to go to a bunch of doctors, chiropractors, and physical therapist to run up the medial bills. This runs up the cost of the settlement, which sounds great. The attorney then takes his 40% plus other cost from the gross amount of the settlement. The plaintiff needs to pay the insurance company back for all the medical expenses.
You get a settlement for $100k and have $15k in medical bills. The attorney takes $40k plus expenses. The plaintiff gets $45k if there are no other cost associated with the case. Not a bad haul for the ambulance chasers. As consumers we take it in the shorts for their abuse of the system.

I don’t do personal injury work, but they are specifically allowed to work on commission because the alternative is that very few people could afford to hire a personal injury attorney. It varies by location, but generally speaking, the public defender’s office represents between 75%-80% of all individuals charged with an offense. And that’s with the threat of being locked in a cage. What percentage of the population can afford to pay an attorney tens of thousands of dollars just to go after more money?
As another poster said, if the ultimate fee is unreasonable, they have to deviate down. But as yet another poster said, they would be happy for you to pay them by the hour. No refund if you get zeroed, though.

Parasites would be nice if all billboards companies and TV stations would refuse to run their ads but they are dependent on that money

You could probably find several that would, but over 70% of Americans don't have $1000 in savings, so their ability to come up with a retainer, much less keep up with the monthly bills, is basically zero.

It's not just the 40%, they charge all expenses on top of that. So it's more like 65 to 70%. You will be lucky to get 30% of settlement
