Things like this will get interesting once "not being able to ask if you're a felon/been arrested" goes mainstream.

All of the questions you asked will be answered during litigation. Do you think Albertsons is going to volunteer potentially damaging information willingly?

Also, Google "vicarious liability". I have no idea if this applies in Montana.

There should be lawsuits when the entity involved is at fault.

How is Albertsons at fault here?

Would they still be at fault if it happened on their property and he wasn’t an employee?

What about actions he takes off of their property during his time as an employee?

What about the actions of non-felon employees? The fact that he is a felon seems to be the driving force of many people’s arguments.

The only view I hold is that the one who committed the act is at fault.

I don’t see how Albertsons should be liable for employee actions that they didn’t support or have them perform.

Vicarious liability is a legal doctrine that holds the employer responsible for tortious acts and negligence of an employee.

I’d imagine whatever insurance is available has a criminal acts exclusion, though.

Companies have been held liable for their employees off property.
