re: Montana couple sues Albertsons after knife slashing
Few noticed that at IHOP until a few of them got plugged over one of them “disrespecting” someone at some period before that shift.

Once the story got out, people started asking how many employees are work release guys.

Must not be yours either or are you incapable of understanding a simple question.

I asked, So, no matter what the felony, they should be held liable? What if it was malfeasance in office? Felony DWI?

Care to answer or are we going to get another zinger?

Why aren't they suing the perp?

For example, if you are involved in a car accident where it is deemed the other drivers fault and obtain counsel, your attorney is not going to try and sue the other driver. Your attorney is going to go after the deep pockets, the insurance company.

Thanks, I know this. Rhetorical question.

For their negligent acts, sure.

In what way were they negligent?

Did they not perform a background check?

Was this a burglary?

Is your viewpoint that felons should never be hired by a business?

Would the suit be appropriate if the individual wasn’t a felon?

Would it still be appropriate if he was just on the property and not an employee?

How about this, an individual attacked someone and Albertsons had no part in the act, therefore, the only one responsible is the felon.

Hell, what if he wasn’t a felon and was just an employee?

Should Albertsons still be held liable?

Do we draw the line somewhere?

I wonder how stringent the background checks are at grocery stores?

What if the perp lied on his application?

Did you ever stop to think that it may not have been a mostly peaceful slashing?

The article also says the guy had been committed to the state's psychiatric hospital. I wouldn't be surprised if the plaintiffs attorney's dig up clear evidence that this guy was a ticking time bomb. They probably expect to. I feel for the guy who got slashed and had his livelihood as a mechanic wrecked.

Didn't LA just pass that "Ban the Box" law where employers aren't allowed to ask about prior convictions? That would certainly change things.

If you walked into McDonalds and got shot by a McDonalds employee, who would you sue?

Burglary is not a violent crime. So no Albertsons is not responsible for that. History of mental illness, have to know more there. Maybe nothing violent there either. If Albertsons is held responsible for felons or mentals with non violent pasts then nobody will ever employ anybody with any felony conviction or any history of mental problems. I suspect this is another vulture lawyer looking for an out of court settlement.

There should be no lawsuits ever unless it’s doctors suing hospitals over non-competes or other doctors over surgery centers.

More than likely they use a third party to address the background check process. Many of these services like checkr, intelius, ect ect only go back 7 years.
